The Kerala High Court ruled that no Hindu undivided family came into existence on the marriage of the assessee due to the Kerala Joint Hindu Family System (Abolition) Act, 1975. The court held that the property obtained by the assessee lost its ancestral character after the Act came into force, and no undivided family could be revived. The Tribunal's decision was upheld in favor of the Revenue and against the assessee.
