2024 (2) TMI 81 - AT - Service Tax


Issues Involved:

Classification of Services:
The appellants sought consideration of additional grounds related to the classification of services as 'works contract service' instead of 'dredging service'. The appeals were filed against the orders confirming the service tax demand based on the classification of activities as dredging service. Remand and Decision:
The Tribunal set aside the impugned orders and remanded the matter back to the original authority for a comprehensive reevaluation of the issues. The original authority was instructed to consider all allegations against the appellants, review submissions made during the adjudication proceedings, and provide an opportunity for a personal hearing before making a decision. All appeals filed by the assessee-appellants and the Revenue were allowed by way of remand, and miscellaneous applications were disposed of accordingly.
