Rule 33 - Application for review - Multi-State Cooperative Societies Rules, 2002Extract Application for review 33. (1) Every application under section 101 shall be in the form of a memorandum setting forth concisely and under distinct heads the new and important facts which after the exercise of the due diligence, were not then within the knowledge of the applicant or could not be produced by him when the order was made or mistake or errors apparent on the face of the record or order reasons on the basis of which review is sought. It shall be accompanied by a memorandum of evidence. (2) The application shall be accompanied by the original or a certified copy of the order to which the application relates. (3) No application for review shall be entertained unless it is accompanied by such additional number of copies as there are parties to the original order. (4) An application for review by any party shall be made within thirty days from the date of communication of the order of the appellate authority sought to be reviewed. (5) The application shall, so far as it may be necessary, be disposed of by the appellate authority in such manner as may be deemed fit: Provided that no order in review application shall be made unless notice has been given to all interested parties and they have been afforded a reasonable opportunity of being heard. 1 [ Provided further that the Appellate Authority shall pass such order within a period of 180 days except in the cases where there is any order, stay or restraint or injunction from any competent court ] ********** Notes 1.
