Abhilash Vinodkumar Jain s case (1995 (3) TMI 344 - SUPREME COURT OF INDIA) and the other in J.K. (Bombay) Ltd. s case (2001 (1) TMI 894 - SUPREME COURT OF INDIA), on the interpretation of section 630. Hence it will be appropriate to refer the matter to a Larger Bench.
The Supreme Court interpreted section 630 of the Companies Act, 1956, stating that "officer or employee" includes legal heirs of deceased employees. However, there was a conflict in interpretation between two cases, leading the Court to refer the matter to a Larger Bench for clarification.
