2018 (2) TMI 930 - AT - Service Tax


Issues:
Refund claim on service tax paid for construction activities - Eligibility of exemption for services provided to universities.

Analysis:
The appeal and stay application were filed by the Revenue against Order-in-Appeal No. 692/2017, where the respondent, engaged in construction activities, sought a refund of service tax paid on specific construction work. The original authority partially allowed the refund, granting it for services to Government Departments but denying it for services to universities. The Commissioner (Appeals) remanded the issue back to the original authority for fresh adjudication. The main ground of appeal by Revenue was the eligibility of exemption for services to universities.

Consequently, the impugned order was set aside, and the appeal was disposed of, along with the stay application. The Tribunal emphasized the need for a fresh adjudication based on the law, without prejudice from past observations, to determine the eligibility of the refund claim for services provided to universities.
