2022 (12) TMI 1042 - HC - Indian LawsSeeking grant of anticipatory bail - Sections 379-B and 307 of the Indian Penal Code (Section 307 IPC added later on and Section 285 IPC deleted) and under Section 25 of the arms Act - HELD THAT - Since the petitioner has joined the investigation and his custodial interrogation is not required, the present petition is allowed and the interim order dated 05.04.2022 is made absolute - However, the petitioner shall continue to join investigation as and when required to do so and shall abide by the terms and conditions, as laid down under Section 438 (2) Cr.P.C.
The petitioner filed a petition for anticipatory bail in a case involving FIR No.189 dated 09.07.2021, under Sections 379-B and 307 of the IPC and Section 25 of the Arms Act at Police Station Mundkati, District Palwal. The petitioner joined the investigation, and custodial interrogation was deemed unnecessary. The petition was allowed, and the interim order dated 05.04.2022 was made absolute. The petitioner must continue to cooperate with the investigation and follow the conditions under Section 438(2) Cr.P.C.
