Citing a precedent set by the Hon'ble Madras High Court, it was clarified that the term 'buyer' in such cases does not necessarily refer to the ultimate consumer. As the law laid down in the Madras High Court case was applicable and no contrary law was presented, the Commissioner (Appeals) decision to allow the refund claim was upheld.

Ultimately, the appellate tribunal concluded that the Commissioner (Appeals) had rightfully reversed the order-in-original and allowed the refund claim. Finding no legal flaws in the decision, the appeal of the Revenue was dismissed.
