Subject:- Inspection of documents kept by Registrar - Copies of correspondence passed between Registrar and companies - Whether can be given It has been brought to the notice of this Department that parties sometimes approach the Registrar of Companies for certified copies of the correspondence which had passed between the Registrars and the concerned companies. Section 610(1)(a) entitles a person to inspect any document filed or registered by the Registrar in pursuance of the Act or any document recording any fact required or authorised to be recorded or registered in pursuance of the Act. Section 610(1)(b ) enables him to obtain a certified copy of extract of such document on payment of the prescribed fees. Since normally the correspondence between the Registrar and the company cannot be regarded as a document filed or registered with the Registrar in pursuance of the Act, it is not open to the Registrar to afford inspection of such correspondence, or supply any copy thereof, to any party. The position would, however, be different if the Registrar was required to produce such correspondence under orders of the court.
