Extension in validity of DEPB for Silk Product - DGFT - 65 (RE-01)/1997-2002Extract Extension in validity of DEPB for Silk Product PUBLIC NOTICE NO. 65 (RE-01)/1997-2002 Dated 01/02/2002 In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002 as notified in the Gazette of India extraordinary, Part-II Section-3, Sub Section (ii) vide S.O. No 283(E) dated 31.03.1997, the Director General of Foreign Trade hereby lays down the following guidelines in respect of grant of revalidation of DEPB licences for embroidered silk items and the acceptance of applications under para 7.39 of the Handbook of Procedures (Vol 1) for issuance of DEPB licences for embroidered silk items. 1. In some instances, the DEPB benefit has not been availed of by the licence holders in respect of DEPB licences issued for embroidered silk items on account of deliberations on specific issues relating to the permissibility of DEPB for embroidered silk items between the Customs and the DGFT . Since the matter stands resolved with the issuance of the Customs Circular No 83/2001 dtd 20.12.2001, it has, therefore, been decided that the validity period of DEPB licences issued in respect of embroidered silk items under DEPB Sr. Nos 74, 75 76 shall be extended for a period of six months from the date of issuance of this Public Notice. For this purpose, the licence holders may apply to the concerned Regional Licencing Authorities within a period of 60 days from the date of issuance of this Public Notice with a request and and a TR/ demand draft for Rs 200. 2. Similarly in cases, where DEPB licences have been granted for silk products as well as products other than silk, under the Textiles Products Group but the DEPB benefit has been allowed only on non-silk products and not on embroidered silk products, the Regional Licencing Authority shall extend the validity of such licences for a period of six months from the date of issuance of this Public Notice. For this purpose, the licence holders may apply to the concerned Regional Licencing Authorities within a period of 60 days from the date of issuance of this Public Notice with a request and a TR/ demand draft for Rs 200. 3. If the applications for obtaining DEPB credit in respect of exports of embroidered silk items have not been filed or not been accepted by the Regional Licencing Authority on account of their becoming time barred in terms of para 7.39 of the Handbook of Procedures (Vol 1), such applications may be accepted by the Regional Licencing Authority. For this purpose, the licence holders may apply to the concerned Regional Licencing Authorities within a period of 60 days from the date of issuance of this Public Notice. However, the above facilities of extension of the validity of the DEPB and consideration of time barred applications shall not be granted by the licencing authority in cases where misrepresentation/ fraud has come to their notice or adjudicating orders have already been passed.
