Appointment of M/s. Air India Air Transport Services Limited (AIATSL), the wholly owned subsidiary company of M/s. Air India Limited, Mumbai–400099, as a Customs Cargo Service Provider - Customs - 04/2015-16Extract OFFICE OF THE COMMISSIONER OF CUSTOMS (GENERAL) AIR CARGO COMPLEX, SAHAR, ANDHERI (EAST) MUMBAI 400099 F.No.S/3-Prev.Admn-74/2007 ACC Date: 15.04.2015 PUBLIC NOTICE NO. 04 /2015-16 M/s.National Aviation Company of India Ltd. (NACIL) [Presently known as M/s.Air India Ltd. a Public Sector Undertaking of GOI] was approved vide Public Notice No.12/2010 dtd.16.04.2010, as a Customs Cargo Service Provider (CCSP)/Custodian of cargoes to be imported or exported by Air India or any other airline, for which Air India was appointed as Ground Handling Agent for the purpose of safe custody of Import/export cargo/goods at Air Cargo Complex, Sahar, Andheri (E), Mumbai, until the goods/cargoes are cleared for home consumption or for warehousing or for transshipment or for export in accordance with the provisions laid down under the Customs Act, 1962 and Rules and Regulations made thereunder, subject to certain conditions specified therein. The said appointment was valid for a period of five (05) years i.e. upto 15.04.2015. 2. WHEREAS M/s.Air India Ltd. (formerly known as M/s.NACIL) vide their letter dtd.24.11.2014 have applied for renewal of their Cargo Custodianship at Air Cargo Complex, Mumbai. Thereafter, M/s.Air India Ltd. vide their letter dtd.17.03.2015 have requested for renewal and transfer of their Cargo Custodianship in the name of M/s.Air India Air Transport Services Limited (AIATSL), the wholly owned subsidiary company of M/s.Air India Ltd - a Public Sector Undertaking of GOI. 3. WHEREAS M/s. Air India Air Transport Services Ltd. (AIATSL), the wholly owned subsidiary company of M/s.Air India Ltd. have executed a Custodian Bond of ₹ 317 crores (Rupees Three hundred Seventeen crores only) towards Custodianship of Import/Export goods/cargoes at Air Cargo Complex, Sahar, Mumbai 400 099, until the goods/cargoes are cleared for home consumption or for warehousing or for transshipment or for export in accordance with the provisions laid down under the Customs Act, 1962 and Rules and Regulations made thereunder. The said Custodian Bond is valid till 10.04.2020. 4. NOW THEREFORE, in exercise of the powers conferred under Section 45(1) and 141(2) of the Customs Act, 1962, I, Jai Prakash Singh, Commissioner of Customs (General), Air Cargo Complex, Sahar, Andheri (E), Mumbai 400 099, do hereby appoint M/s.Air India Air Transport Services Limited (AIATSL), the wholly owned subsidiary company of M/s.Air India Limited, Mumbai 400 099, as a Customs Cargo Service Provider (CCSP)/Custodian of cargo/goods to be imported or exported by all Airlines handled by Air India for the purpose of safe custody at Air Cargo Complex, Sahar, Andheri (E), Mumbai 400 099, until the goods/cargo are cleared for Home consumption or Warehoused or Transshipped or till the export goods are exported, in accordance with the provisions laid down under the Customs Act, 1962 and any other Laws, Rules and Regulations, Notifications, Instructions, Circulars, Public Notices made thereunder, subject to following conditions :- (a) The CCSP/Custodian shall comply with all the provisions of the Customs Act, 1962 and any other Laws, Rules and Regulations, Notifications, Instructions, Circulars, Public Notices for the time being in force, that is being enforced by Customs and are applicable to Customs Cargo Service Provider/Custodian of goods/cargo in Customs Area. (b) The CCSP/Custodian shall comply with all the provisions of Handling of Cargo in Customs Area Regulations, 2009 issued by Government of India, Ministry of Finance, Department of Revenue, Central Board of Excise Customs, New Delhi, as amended from time to time. (c) The CCSP/Custodian shall pay to the Government or the proper officer, any amount of Customs Duty payable on the imported goods pilfered or not accounted for, as per Section 45(3) of the Customs Act, 1962. (d) The CCSP/Custodian shall insured all the goods (imported/export) held in the Customs area at Air Cargo Complex, Sahar, Mumbai 400 099 against all kinds of risks. The amount of insurance to be provided by CCSP should be equal to the average value of goods likely to be stored in the Customs area for a period of 30 days (based on projected capacity). (e) The CCSP/Custodian shall bear the cost of the Customs officers posted, at such Customs area, on cost recovery basis, by the Commissioner and shall make payments at such rates and in advance of atleast three months, unless specifically exempted by an order of the Government of India in the Ministry of Finance. (f) The CCSP/Custodian shall not lease, gift, sell or sublet or in any other manner transfer any of the premises in a customs area; or sub contract or outsource functions permitted or required to be carried out by them in terms of Handling of Cargo in Customs Area Regulations 2009 to any other person/organization, without the written permission of the Commissioner of Customs. (g) The Customs Cargo Service Provider/Custodian shall publish and display at prominent places including website or webpage of the Customs Cargo Service Provider, the schedule of charges for the various services provided by them/him, in relation to the imported goods or export goods in the Customs area. (h) The CCSP/Custodian shall provide Infrastructure, equipment and adequate manpower for loading, unloading, stacking, handling, stuffing and de-stuffing of containers, storage, dispatch and delivery of containers and cargo, etc., to the satisfaction of Commissioner of Customs, ACC, Mumbai. The CCSP shall provide safe, secure and spacious premises for loading, unloading, handling and storing of the cargo for the projected capacity and for the examination and other operations as may be required in compliance with any law for the time being in force. (i) The CCSP/Custodian shall keep a record of imported goods, goods brought for export or transshipment, as the case may be and produce the same to the proper officer as and when required and shall not permit imported goods and export goods to be removed from the port premises of Air Cargo Complex, Sahar, Andheri (E), or otherwise dealt with except under and in accordance with the permission in writing of the proper officer of Customs, Air Cargo Complex. The CCSP/Custodian shall keep a record of each activity or action taken in relation to the movement or handling of imported or export goods and goods brought for transshipment. (j) The CCSP/Custodian shall fulfill all the conditions specified in Regulation 5 of Handling of Cargo in Customs Area Regulations 2009 (as amended from time to time) and shall discharge their responsibilities promptly effectively as specified in Regulation 6 of Handling of Cargo in Customs Area Regulations 2009 (as amended from time to time). (k) The CCSP/Custodian shall not make any alteration of the plan in the accommodation, boundary wall, building, etc. without the concurrence of the Commissioner of Customs, Air Cargo Complex, Mumbai. (l) The goods shall be stored in the areas as specified in the below mentioned schedule: SCHEDULE CARGO HANDLED STORAGE AREA EXTENT OF AREA OCCUPIED BY M/s.AIR INDIA AIR TRANSPORT SERVICES LTD. AND TYPE OF CARGO HANDLED Module I (Export Shed) Area for Export cargo Module III (Heavy Shed Light Shed) Entire area occupied for Heavy and Light Import cargo. ETV Warehouse Entire area for Import, Export, Transshipment cargo, Precious cargo. APEDA (Agricultural Processed Food Products Export Development Authority) Shed Entire area for Perishable cargo. 4. The duration of the said appointment shall remain valid for a period of two (02) years, effective from 16.04.2015.
