PUBLIC NOTICE No. 37/2009 BKS DATED 25.03.2010 Subject:-Procedure to be followed in case of Registration of Duty Credit Script issued under Served from India Scheme Certificate (SFISC); Vishesh Krishi and Gram Udyog Yojana (VKGUY); Target Plus Scheme (TPS); Focus Market Scheme (FMS) Focus Product Scheme (FPS) -reg. Attention of the all Importer/Exporters/CHAs and all concerned is invited to the Notification No.92/2004-Cus dated 10.09.2004 (Served from India Scheme Certificate); 32/2005-Cus dated 08.04.2005 (Target Plus Scheme); 41/2005-Cus dated 09.05.2005 (Vishesh Krishi and Gram Udyog Yojana): 90/06-Cus dated 01.09.2006 (FMS) Focus Market Scheme, 91/06-Cus dated 01.09.2006 (FPS) Focus Product Scheme. Keeping in view the changes that have been brought in the Foreign Trade Policy (2009-14) and Boards Circular No.26/2009 dated 30.09.2009 which operationalized the changes contained in the FTP 2009-14, public notice No.01/09-BKS dated 16.10.2009 issued from F.No.S/6-Gen-13/2008 DEPB(V), the procedures relating to registration of the said scrips hiterto followed need to be lined up with the above requirements of the FTDO and Boards instructions. According, hence forth the following procedure for registration and verification will be in place. (I) The Lincence holder/authorized representative will present the licence/scrip to Licence Section alongwih a request letter and photocopy of the licence/scrip including annexure for endorsement of NO ALERT on the Licence. The Custom Officers (Superintendent/Appraiser) of the Licnece Section well endorese NO ALERT on the Original Cusotm Copy of licence/scrip after checking the alert list maintained in the Licence Section and return the original Licence/scrip to the Licence holder/authorized representative. (II) Para 3.11.3 of Hand Book of Procedure Vol.-I states that- Duty Credit Scrip ( including splits) shall be issued with a single port of registration which shall be the port of export. After issue of Duty Credit Scrip, but before registration, Customs Authorities shall verify genuineness of Duty Credit Scrips, from Regional Authorities concerned, until EDI System of message exchange is put in place. Therefore, upon receipt of the Licences for registration, the Customs Officer shall write/fax to the concerned Regional Licencing Authorities so as to confirm the genuiness of the issue of the Licence and particulars contained therein and the Annexure the form part of the said Licences. The request letter for verification from Customs Authority to Licencing Authority will be sent/faxed within two working days from date of receipt of application from licence holder for registration of licence. As per communication received from office of the DGFT, New Delhi, All RAs (Regional Licencing Authorities) have been requested that confirmation of genuineness of Scrips should be issued within a week of the receipt of request from Customs. (III) The Licence- holder or their representative shall submit the copy of the Licence alongwith application to the EDI Service Centre for entering the details of Licence in the EDI System. The EDI Service Centre will generate the CHECK LIST. The Check list will be checked or verified by the Licence holder or their representative. After verification of check list by the Licence-holder or their representative, the check list shall be submitted for generation of: JOB NUMBER. (IV) The Superintendent/Appraiser (Licence), after getting verification of genuiness of scrip/licence from the Licencing Authority, will accept the Job Number submitted by the Licence-holder or their representative and endorse the Licence registration Numbers on the Licence and return the Licence to the Licence-holder or their representative. Thereupon the Licence-holder is eligible to use the scrip for the purpose of debiting the duties on the imports against the said Scrip. (V) However, the Customs Authorities (SIIB/CIU) on receipt of information/intelligence will take up any such registered Licences for details scrutiny and investigation so as to see whether any mis-declaration or misrepresentation or any fraud/default has been committed in violation of the conditions of the relevant customs exemption notifications or the Foreign Trade Policy,2009-14.
