Online transmission of Licence and amendments under Advance Authorisation (DEEC) And Export Promotion Capital Goods (EPCG)Scheme- Reg. - Customs - 38/2010Extract OFFICE OF THE COMMISSIONER OF CUSTOMS (EXPORT) JAWAHARLAL NEHRU CUSTOM HOUSE, SHEVA TAL - URAN, DIST-RAIGAD, MAHARASHTRA- 400707 File No.- S/5-611/Misc-/2010/Licence/JNCH Date :- 26/03/2010 FACILITY NOTICE NO. 38/2010 Subject :- Online transmission of Licence and amendments under Advance Authorisation (DEEC) And Export Promotion Capital Goods (EPCG)Scheme- Reg. Attention of the all Importers/Exporters/CHAs and DEEC and EPCG Linence-Holders and all concerned is invited to the CBEC Circular No. 3/2009-Cus Dated 20/1/2009 and Public nos 43/2009 dated 15/07/2009 and 18/2009 dated 13/04/2009 whereby a procedure for online transmission of Licence and amendments under Advance Authorisation (DEEC) and Export Promotion Capital Goods (EPCG)Scheme from DGFT to Customs was prescribed. 2. The importers and their representative CHAs are requested to submit the import B/Es alongwith the relevant EPCG Licences against which manual clearance was allowed due to system problem in accepting the new notifications of EPCG Scheme during September 2009 to December 2009 under customs notification Nos 100/2009 ; 101/2009 ; 102/2009 103/2009 to the Appraising officer (Group 7 G) for proper debiting of the EPCG Licences in the EDI System. 3. All the Advance Authorisations/EPCG licences issued on or after 1/3/2009 and any amendment concerning these licences are being transmitted online from DGFT to Customs. Consequently, any manual entry of amendment is not feasible at Customs end in respect of online-transmitted licences. The Customs Authority is to check the No Alert and verify the details of Licences/Amendments by comparing it with the hard copy of the Licence/Amendment sheet issued by the Licencing Authority before registration of licence or approving the amendment in the EDI System. 4. Some licence holders and their representatives have brought to notice few problems faced by them related to the online transmission of Licences and amendments. The issues and the measures taken by this Customs House to remove the difficulties faced by the licence holders are as follows :- 4(1) Individual value restrictions of items under Advance Authorisation Scheme even though the Foreign Trade Policy does not prescribe any such restriction :- This matter was taken up by the D.G.(System), New Delhi. During the joint meeting of Customs and DGFT Authorities. As per communication received from ADG (System) it has been confirmed that the amended software has been released by the DGFT on 05.02.2010 and the new licenses will not have the mandatory individual restrictions. The Licences issued earlier can also be submitted to DGFT/Licence issuing authorities for making necessary changes and transmission to ICEGATE. 4 (2) Non transmission of EODC online under Advance Authorisation Scheme- as a result even though EODC has been received by the Licencee, the licence holder is required to furnish Bond for duty free import as there is no provision of entering the details of EODC manually : This Custom house had taken up the matter with the D.G.(System), New Delhi. It was informed that the software for the same is being developed by the NIC. Till the software is developed by the NIC, the licence holders would be required to execute the Bond with Customs as per prevailing practice. 4 (3) Non transmission of licence and amendments online in certain cases : In the online transmission system a licence transmitted by DGFT is subjected to certain online validation checks at ICEGATE. If it validates all the data checks the licence is accepted and the same is transmitted to respective location e.g. JNPT and details of these licences are available at ICEGATE website. The licence which do not pass online validation checks are rejected and acknowledgment with pre-agreed Error Codes is sent by Customs (ICEGATE) to DGFT. Such licences are available at DGFT website (www.dgft.gov.in licence status at DGFT) with Error Codes and will neither be displayed at ICEGATE website nor would they be available at the concerned ICES location e.g. JNPT. In all such cases except for the Error Code 93, the problem can be resolved by DGFT only. Detailed information regarding resolution of such problems is available at ICEGATE website at following link (http://icegate.gov.in/moreinfo/Licence_Transmission.pdf), which is self explanatory. Further if online Licence is not transmitted by DGFT to ICEGATE for validation for any reason, such licence would not be available at DGFTs website also. For all such case action lies at the end of DGFT to transmit such licence to ICEGATE. Therefore, it is advised that the licence holder should check the status of transmission of his Licence or Amendment from ICEGATE to Custom House before submitting it to Customs Authority for approval of any amendments. If there is any error in transmission, then as per Error Code (type of error) which is also displayed on website of ICEGATE, the licence holder is requested to get the error rectified or get re-transmitted the correct details from the Licencing Authority. 5.
