PIN 400707 F. No. S/22-Gen-38/2015-16/AM(X)/(Part-I) Dated 16.01.2017 Public Notice No. 09/2017 Sub: - Options for DPD Clients availing DPD facility -Reg. Attention of the Importers, Exporters, General Trade, Port Terminal Operator, Shipping Lines/Shipping Agents, CFSs coming under the jurisdiction of JNCH, Nhava Sheva and all other stakeholders is invited to various other decisions communicated through Public Notices [Public Notice No 161/2016, dated 28.11.2016 (DPD facility to 467 importers), Public Notice No 180/2016, dated 19.12.2016 (DPD facility to another 214 bid importers), Public Notice No 160/2016, dated 29.11.2016 (creation of dedicated DPD/RMS Facilitation Centre at JNCH),Public Notice No 08/2017, dated 16.01.2017 and other Public Notices issued from time to time for smooth clearing of consignments and to reduce dwell time of import. 2. It has been represented by various importers that they are finding it difficult to make logistics arrangement for early evacuation of DPD containers from Terminal Area. The difficulty expressed by them includes: i. Arrangement of Transporter; ii. Risk of theft, issue of insurance; iii. Two shift handling charges being charged by Private Terminal Operators; iv. Dealing with Non RMS Containers; v. Sometimes, lack of sufficient storage space in their factory premises and they require temporary storage for Customs cleared cargo or warehousing facility; vi. Cash flow issues; insufficient funds for payment of customs duty delivery order charges; vii. Sometimes, container needs to be de-stuffed/shifted to other mode of transport; viii. RSP/MRP stickers to be affixed before clearance (requiring Customs bonded warehouse); Therefore, a meeting with representatives of all CFSs in the jurisdiction of JNCH was called to ascertain their views and solution to logistic arrangements. Logistic Solution through Transporter Model 3.It was also discussed that JNPT is already preparing to logistic solution in the form of engaging 5-7 major transporters who will provide transport services to DPD Clients in efficient manner and evacuation of containers from Terminal will take place on best pick up basis. This will facilitate further rationalisation of shifting charges being charged by Terminal Operators. DPD Clients can avail the aforesaid logistic solution. 4.The issue of Non RMS cargo of a DPD Client has already been clarified/provided in the Public Notice No 08/2017, dated 16.01.2017 which provides that CFSs will be responsible to provide logistic solutions to such containers requiring examination at CFSs. It has also been clarified in the said Public Notice that in case, Bill of entry filed by Importer in respect of any such containers is not RMS Facilitated and requires examination or Containers are RMS Facilitated but requires examination at CFS due to CSD hold in terms of Public Notice No 06/2017, dated 12.01.2017, then such containers need to be moved to preferred CFS as indicated by importer in the advance intimation submitted to shipping line, Port Terminal and CFS. For that purpose, importer and concerned CFS to take immediate action for moving such container from Port to CFS. Further clearance of such consignment should take place from CFS as per normal procedure. Logistic Solution by CFS 5.CFSs were asked to take proactive steps in providing logistic solution to above issues raised at Para 2 by DPD Importers. CFSs were advised that they can earmark a separate space/area in their CFSs for (a) storage of Customs cleared DPD cargo (OOC already given) if there is requirement of temporary storage by any DPD importer (b) CFSs were also advised that they can also apply for Licensing of warehouse under Chapter IX of the Customs Act, 1962 for providing certain services to DPD Clients (like completion of PGA (Participating Government Agencies etc.). All the CFSs were also advised that they should pro-actively engage with all the DPD Clients (list already available with them as well as available on JNCH website) to express their willingness to provide these services to DPD Clients. To the above suggestion, all the CFSs expressed willingness. It was informed by them (CFSs)that: i. On being engaged by DPD importer, they can provide transport facility to evacuate any container from Port Area and deliver the cargo directly to the premises of a DPD importer; ii. They already have arrangement for ensuring safety and security of cargo (as they are using GPS enabled tracking system) and also provide insurance cover; iii. If any DPD importer intends to engage any CFSs for clearance of their RMS Facilitated cargo (For Non RMS Cargo, Importer have to necessarily engaged services of a CFS) , they can make request of the same to Shipping line Port Terminal so that such containers are stacked in stacking meant for that CFS. iv. Stacking of RMS facilitated cargo of a DPD importer in CFS Stacking will also be beneficial for importer as they would not be required to pay any double shifting charges being collected by Private Terminal Operator from DPD Clients. v. They can also provide temporary storage facility of Customs cleared cargo in their CFSs, if required by importer for any reason; vi. They can also provide facility for affixing MRP/RSP Stickers in their premises. vii. They can also provide de-stuffing or other similar facilities to DPD importers if required by any importer. viii. They will actively participate in the DPD facility being extended by Government to importers to reduce time and cost. 6. It was also informed to CFSs that Customs will expeditiously process any request for earmarking separate storage of Customs Cleared Cargo or Licensing of Warehouse . In case of any difficulty, the specific issue may be brought to the notice of Additional Commissioner/Joint Commissioner in charge of in-charge of DPD Cell/RMS Facilitation Centre or CFS Management Cell for remedial action. 7. DPD Clients are requested to approach the CFSs to finalise their logistic arrangements in case they don t prefer to employ their own logistic solutions. It is clarified again that DPD clients can use CFS for dealing with Customs cleared cargo for logistic purposes. 8. This, issues with approval of the Chief Commissioner of Customs, Mumbai Zone-II.
