No. S/20-06/DBK/ 18-19 Kandia, Dated 11.06.2019 PUBLIC NOTICE NO. 20/2019 Sub: Clearance Of Drawback claims pending under Brand Rate-Reg. It has been observed that a large number of Drawback claims under brand rate are pending in this Commissionerate for want of submission of brand rate sanction / fixation orders from jurisdictional Central Excise/ Customs authorities. Many of these shipping bills are pending for more than 3 years. The list of exporters whose claim is pending for brand rate fixation is annexed with this Public Notice. Further, details of shipping bills pending, can be obtained from the Superintendent Drawback Section, Room No. 09, Ground Floor, Custom House, Kandla. Same is also available at the web site www.kandlacustoms.gov.in 2. The effort made in the past with individual Exporters as well as their Custom House Brokers to liquidate the pending cases have not proved fruitful. Therefore all exporters/ CHAs are advised:- I. To submit the brand rate sanctioned/ fixation letters issued by the jurisdictional Central Excise / Customs Commissionerate; or II. Where the Brand Rate has not yet been sanctioned / fixed, a copy of the application filed by the exporter with the jurisdictional Central Excise / Customs authorities accompanied with a self-declaration to the effect that the brand rate has not been fixed (both documents duly attested by the jurisdictional DC/ AC of Central Excise/ Customs), be submitted. 3. In case the documents, as at sl. No. 2(i) or 2(ii) above, are not submitted on or before 24.06.2019, the pending claims shall be processed at zero rate without any further reference. However, where the brand rate shipping bills is sanctioned at zero rate, the exporter is at liberty to file the Supplementary claim as provided under Rule 16 of Customs and Central Excise Drawback Rules, 2017. 4. All the Exporters/ CHA are requested to take not for suitable compliance so that pending Brand Rate Drawback claims could be disposed off at the earliest.
