No. VIII(H)48/CT/PN/57/2010 Dated: 30.07.2019 PUBLIC NOTICE NO. 20/2019 Subject: Permission for carriage Of Customs Bonded Transshipment (Import) cargo from all Customs Airport of India to Jaipur Airport Carriage of Customs Bonded Transshipment (Export) cargo from Jaipur Airport to all Customs Airport of India -reg. In modification of Public Notice no. 09/2015 dated 05.08.2015, Public Notice no. 13/2016 dated 23.08.2016, Public Notice no. 16/2017 dated 04.08.2017, Public Notice no. 18/2018 dated 30.07.2018, attention to exporters, importers and all other concerned is invited to the movement of Customs Bonded Transshipment cargo by airlines from to/from Jaipur Airport. In this regard, M/S Inter Globe Aviation Limited a private airline operator, approved as a scheduled Air Transport Operator by the Director General of Civil Aviation, New Delhi have presented an application seeking permission to carry Customs cleared transshipment (Import) cargo from all Customs Airport of India to Jaipur Airport and to carry Customs cleared transshipment (Export) cargo from Jaipur Airport to all Customs Airport of India for custody of such cargo at Jaipur airport. 2. Now, therefore, in exercise of the power conferred upon me under Section 45(1) of the Customs Act, 1952. I, S. C. Agarwal, Commissioner of Customs (Preventive). Jodhpur hereby approve M/S Inter Globe Aviation Limited as the custodian of imported goods landed at international Airport, Jaipur by way of transshipment from all Customs Airport of India through the flight operated by them to Jaipur Airport subject to fulfillment of such conditions as may be prescribed in this behalf by this office from time to time. They are also permitted to carry transshipment of export cargo from Jaipur to all Airport Of India subject to fulfillment of such conditions as may be prescribed in this behalf by this office from time to time. 3. The permission for transshipment of Import/Export cargo is subject to the terms and conditions as prescribed in Goods Imported (Conditions of Transshipment) Regulations, 1995 as amended and Board's Circular No. 6/2007 dated 22.01.2007. 4. M/S Inter Globe Aviation Ltd shall follow the procedure prescribed in chapter VIII of the Customs Act, 1962. Goods Imported (Conditions of Transshipment) Regulations, 1995 read with CBEC Circular No. 69/99-Cus dated 06.10.1999, Circular No. 61/2000-cus dated 13.07.2000, Circular No. 78/2001-cus dated 07.12.2001, Circular No. 79/2001-cus dated 07.12.2001, Circular No. 45/2005-cus dated 24.11.2005 and Circular No. 06/2007-Cus dated 22.01.2007, any other Rules, Regulations, Notifications and Instructions issued from time to time. 5. M/S Inter Globe Aviation Ltd are required to execute Bond equivalent to the value of goods to be transshipped in 3 (three) months and Bank Guarantee to the tune of 15% of the Bond value shall be furnished to ensure proper accountal of cargo under transshipment. The bond and bank guarantee amount are liable to be enhanced depending upon the volume of work handled by M/ s Inter Globe Aviation Ltd. 6. The movement of cargo shall be subject to the order and instructions issued by this Commissionerate or any competent authority from time to time. 7. M/S Inter Globe Aviation Limited shall ensure the storage of the aforesaid cargo at Jaipur Airport within the specified Customs area/ warehouse and shall not move or store such cargo outside the said specified Customs area/ warehouse. The movement of cargo and their storage will be sole responsibility of M/S Inter Globe Aviation Limited and they shall be held liable for any loss, pilferage or damaged caused to the cargo while it is in their custody. 8. The cargo shall be palletized separately from the local cargo. Smaller packets shall be put together in appropriate container and sealed. 9. The cargo shall be manifested separately in the I.G.M. and shall be distinctly marked as International cargo. 10. The movement of cargo from the storage place of the goods meant for transshipment to/fro aircraft shall be under Customs supervision escort. 11. The present permission is applicable for transfer of export cargo originating from Jaipur airport and would not apply to the cargo which would be further transshipped through another intermediate airport before being exported out of the country from any Other airport of India. 12. M/ s Inter Globe Aviation Ltd shall intimate the Customs authorities at the ports of destination be a pre-alert message about the carriage of international cargo on the flights. A copy of the message shall be given to the concerned Customs Officer of the Jaipur airport. 13. M/S Inter Globe Aviation Ltd shall make necessary arrangements at ports of destinations to remove the cargo and deposit the same with the custodian thereof appointed under Section 45 of the Customs Act, 1982 and under customs supervision. 14. M/S Inter Globe Aviation Ltd shall carry the cargo only under an E.G.M. duly certified by the Customs and produce the E.G.M. duly acknowledged by the proper officer of Customs at the port of destination. 15. It the duly endorsed copy at E.G.M. is not received back at Jaipur airport within 30 days, the proper officer shall demand full FOB value at goods within 7 day as a penalty for failure to perform the undertaking to transship within the specified period of time. This action would be in addition to any other action that may be taken under any other law for the time being in force. The penalty demanded shall be payable within 10 days. In the event of failure, the bond may be enforced and no further transshipment may be allowed. 16. At all Customs Airport of India, the cargo received from the inland airport for export to foreign destination shall be dealt in accordance with the procedure prescribed by the Conunissioner of the Customs incharge of the airport. M/S Inter Globe Aviation Ltd will present the copies of EGM received from Jaipur airport in the sealed cover to the officer posted at transshipment warehouse. 17. A monthly statement in this regard, shall be submitted to the Deputy/ Assistant Commissioner of Customs at Jaipur airport. 18. M/S Inter Globe Aviation Ltd is required to adhere to the provisions of the Foreign Trade policy 2015-20 and all other allied Acts in force and enacted/amended by the Government from time to time. 19. M/S Inter Globe Aviation Ltd shall pay the Merchant Overtime for the Customs officers and staff provided for the aforesaid purpose whenever due. 20. M/S Inter Globe Aviation Ltd shall under no circumstances outsource the transshipment activities under this Public Notice without due permission from the undersigned. 21. The permission is valid for a period of one year from the date of issuance of this Public Notice as stipulated under Goods Imported (Conditions of Transshipment) Regulations, 1995 read with CBEC Circular No. 69/99-Cus dated 06.10.1999, as amended time to time. The permission can be renewed on the satisfactory fulfillment of obligations. If any deviations in the compliance/ observance of the provisions of law are noticed the permission accorded will be terminated. (S. C. Agarwal) Commissioner
