No. VIII/Cus/Tech/48-133/1ndigo Cargo/2019 Dated 12/03/2020 PUBLIC NOTICE NO. 19/2020 Sub: Permission for carrying out Export Transhipment of general cargo from Airport Authority of India Ltd., Pune (AAI, Pune) bonded cargo warehouse at Air cargo Complex, Pune Airport to all other Customs Ports within India for the purpose of export from India by Air Vide this Public Notice, permission is being accorded to M/S. Indigo Cargo, a unit of M/S Interglobe Aviation limited, Gate No. 5, Cargo Terminal, Lohegaon, Pune Airport, Pune: 411032 for carrying out Export Transhipment of general cargo from Airport Authority of India Ltd., Pune (AAI, Pune) bonded cargo warehouse at Air cargo Complex, Pune Airport to all other Customs Ports within India for the purpose of export from India by Air. The said transhipment documentation of movement from Airport Authority of India Bonded Cargo Warehouse, Pune to other Air -Cargo Customs Stations shall be done electronically on the Indian Customs EDI System (ICES). 2. The permission vide this Public Notice will be for a period of one year from 18.03.2020 subject to the conditions stipulated below. For Export Cargo 3. The procedure for transhipment of export goods as laid down in Para 4 of Circular No, 6/2007-Cus issued by Ministry of Finance, Department of Revenue, Central Board of Excise and Customs, issued under F, No 450/96/2006-Cus-lV dated 22/01/2007 which will have to be followed for Export of cargo tendered at Lohegaon Air Cargo Complex for export from another Customs Airport is prescribed as follows:- a) The in charge of the carrier has to file EGM with all the details of cargo to be transhipped and Shipping Bill shall be filed at the Air Cargo Complex (ACC) Lohegaon Airport and Let Export Order shall be given by the Customs at the same station. Transhipment Permit (TP) should be prepared by the airlines/ carrier and approved by the proper officer. Transhipment Permit should be sent along with the cargo. Transhipment Bond shall be executed by AAI with the approval of Commissioner of Customs, Pune as per terms and conditions mentioned at Regulation 5(4) of HCCAR' 2009. The said transhipment bond shall be debited for the value of the cargo. b) On arrival at the gateway airport, the cargo should be taken to the warehouse of the domestic airlines/custodian in a clearly identified area. The warehouse should have double locking arrangement, one key of which will be with the airlines/ custodian and the other with Customs. The Customs officers in charge of warehouse should verify the details of the packages with the Transhipment Permit, Airway Bill, etc. The domestic airlines may prepare the Cargo Transfer Manifest (CTM), airlines- wise, which shall be certified by the Export Freight Officer (EFO). c) Cargo should be shifted to the transhipment warehouse in the export terminal of custodian and acknowledgement obtained. No examination of such cargo should normally be done at gateway airport, except on credible intelligence or information. d) When the aircraft is ready for loading, the airlines should seek permission from the EFO for loading. The load plan prepared by the airlines should be signed by the Airlines, EFO and the custodian. e) Cargo should be loaded in the aircraft under Customs supervision. f) Copy of manifest signed by the EFO and Airway Bill along with copy of Shipping Bill should be sent by the airlines to the originating station within 30 days of transhipment. Transhipment Bond shall be re-credited at ACC, Lohegaon. g) In case the transhipment is by bonded truck, the marks and numbers of the packages shall be verified with the details in the transhipment permission and the bonded truck sealed with e-Seal in the presence of the Customs Officer. h) If transhipment of cargo is also desired at some intermediate Customs airport, carrier/ airlines should give advance intimation to intermediary airport Customs at intermediary airport would supervise the movement of cargo and endorse the same on transhipment Permit. The concerned airlines/custodian warehouse should have double locking arrangement, one key of which will be with the Airlines / custodian and the other with Customs, for storage of transhipment cargo. The loading of such cargo again would be under the supervision of Customs Officer. i) If the cargo transhipped under the provisions of the Customs Act, 1962 is not unloaded at the place of destination in India, or if the quantity unloaded is short of the quantity to be unloaded at that destination, and if the failure to unload or the deficiency is not accounted for, then the person-in-charge of the conveyance shall be liable for penal action as per the provisions of Customs Act, 1962. 4. Both the parties i.e. IndiGo Cargo (M/S Inter Globe Aviation Limited) and M/S Airport Authority of India Ltd. bonded cargo warehouse at Air cargo Complex, Pune Airport shall ensure that: a) The packages meant for export should be duly verified/checked and sealed by Customs Officers and the Air Cargo Transfers Manifest (ACTM) should clearly mention the details of cargo. b) The weight mentioned in the Shipping Bill and the ACTM matches in all respects. c) Maintain a register in respect of transhipment of goods and submit them for inspection, when directed by the proper officer. d) The Air Cargo Transfer Manifest (ACT M), containing all the details of Shipping Bills/export goods so carried by the Pilot of the flights carrying the said goods be handed over to the proper Customs Authorities at the respective destination Airport. e) M/S InterGlobe Aviation Limited and M/S AAI shall carryout instructions issued from time to time by the proper officer to ensure safe custody and transportation of export goods to transhipped, due arrival of such export goods at their respective destination and to receive acknowledgements and obtain proof of export from proper officer. f) M/S InterGlobe Aviation ltd. shall pay the cost recovery charges for the Customs Officers and staff provided for the aforesaid purpose, if any, whenever due. M/S InterGlobe Aviation Ltd shall under no circumstances outsource the transhipment activities under this Public Notice without due permission from the undersigned. The relevant documents should be kept in currency at all times and Bank Guarantee should have auto renewal clause. Bank Guarantee may be renewed from time to time. 5. The conditions laid down under Board's Circular No. 06/2007-Cus dated 22/01/2007 and Trade Facility Notice No.01/2017 dated 21.04.2017 and Public Notice No.03/2018 dated 23.01.2018 both issued by Pune Customs Commissionerate are to be followed strictly. 6. M/S. Indigo Cargo (M/S Interglobe Aviation limited). is directed to comply with all the Rules/Regulations of the Customs law and Board's Notifications/ Circulars issued in this regard from time to time, as applicable. 7. The permission is valid for a one year from the date of issue which can be renewed subject to satisfactory fulfilment of terms and conditions. The permission is liable to be withdrawn at any time. 8. Further, renewal shall be considered only after compliance of all the conditions mentioned in the earlier Public notices, Circulars/notifications in the matter. (P.K.
