F. No. VIII/09-19/cus/T/2020-21 Date : 29.09.2020 PUBLIC NOTICE NO. 22/2020 Subject : Drive through X-Ray Based Container scanner facility to be launched shortly at Hazira Port - reg. The Importers, Exporters, General Trade, Port Terminal Operators, Shipping Lines / Shipping Agents, Container Freight Stations coming under the jurisdiction of Ahmedabad Custom House, Vessel Operators / Non Vessel Operating Common Carriers / inland Container Depots and all other stakeholders concerned are hereby informed that the Drive through X-Ray Based Container scanner facility is to be launched shortly at Hazira Port and scanning of selected import containers will commence. The effective date of commencement Of container scanning facility will be intimated shortly. 2. Container Scanning Division: For the purpose, Container Scanning Division (CSD) headed by Deputy / Assistant Commissioner of Customs (CSD) has been created and is functional from Hazira Custom House. 3. Location of Container Scanner Facility: The Drive through X-Ray based container scanner facility is situated at Adani Hazira Port, Nr. Adani Exim Yard, Hazira, Surat - 394270. 4. Movement of Containers selected for scanning: (i) The Containers, which are to be scanned, will be selected by the Container Scanning Module (CSM) of the Risk Management Center of Customs (RMCC). The intimation of selection will be communicated automatically to the Terminal Operators, Liners, Custodians of CFS, DC/AC of CFSs and the Container Scanner Division by email. The DC/AC of CFSs shall forward the selected container lists to the Docks Examination Officers posted at CFS. (ii) The terminal Operator shall be responsible to ensure that the containers selected for scanning are brought to the notice of Terminal Out Gate Dock Preventive Officer by making suitable endorsement Selected for Scanning - in RED COLOUR in the EIR copy of such selected containers as per responsibility cast upon them under the Customs Cargo Service Providers under the Handling of Cargo in Customs Area Regulations, 2009. If the EIR copy Of any such selected container reporting at Terminal Out Gate is not marked as detailed above, then the Terminal Operator will be liable for penal action under the provisions of Customs Act, 1962 read with Handling of Cargo in Customs Area Regulations, 2009. (iii) Thereafter, the selected containers shall be transported from the Container Terminal to the Container Scanning Facility for the purpose of scanning by the Custodians of the respective CFS where the respective containers are to be moved as per responsibility cast upon them under the Handling of Cargo in Customs Area Regulations, 2009. (iv) The Custodian of CFS shall ensure that containers selected for scanning does not reach CFS before scanning at the Container Scanning Facility. If any such selected container reported at the CFS before scanning, then the Custodian of the CFS will be liable for penal action under the provisions of Customs Act, 1962 read with Handling of Cargo in Customs Area Regulations, 2009. 5. procedure to bc followed in Container Scanner Division (CSD): 5.1 On receipt of the selected container at the CONTAINER SCANNING FACILITY, the preventive Officer shall physically verify the container number and seal number printed on the EIR document with the number on the container and seal affixed on the container. If the same are found to be tallying, the container shall be checked in for scanning, otherwise the same shall be reported to DC/ AC (CSD) for further action. 5.2 On completion of scanning of the selected containers at the container Scanning Facility, the Superintendent of the Container Scanning Facility will endorse the following comments on the face of EIR document as the case may be: (a) If the image of the scanned container found to be CLEAN, then the SCANNED CLEAN stamp in BLUE INK shall be affixed on the reverse of the EIR document. (b) If the image of the scanned container found to be SUSPICIAOUS, then the SCANNED MISMATCH stamp in RED INK shall be affixed on the reverse of the EIR document. Thereafter, such containers will be moved for 100% examination by the Docks Examination Officers at the CFS. (c) In case of Odd Dimensional Containers (ODC) / Empty/ Coastal Containers, the number of such containers will be entered in the system and thereafter NOT SCANNED DUE TO ODC/OVERWFIGHT/EMPTY/COATAL CONTAINERS stamp will be affixed on the EIR document. 5.3 Reefer (Refrigerated) containers shall be scanned on priority basis as per procedures mentioned above. 5.4 In case the containers selected for scanning could not be scanned due to non-functioning of the scanner or for any other reason, the Superintendent CSD, shall inform the same to DC!AC (CSI)). The DC/AC (CSD) in turn will decide whether to release the containers without scanning but for regular examination procedure or to hold the said containers. 5.5 If the DC/AC (CSD) order for release of such containers, then the Preventive Officer (CSI)) shall physically verify each container number with the respective EIR copy and then feed each container Number in the system. Thereafter the EIR document of each container shall be endorsed with stamp NOT SCANNED DUE TO on the reverse. 5.6 After completion of scanning of selected containers at the Container Scanning Facility, the said containers shall be moved to the respective CFS by the Custodians of the said CFS. 5.7 No Container shall be examined / detailed at the Container Scanning Facility. 6. DPD facilitated containers selected for Scanning : (i) The Terminal Operators are required to ensure that the DPD facilitated importers or their Custom Brokers are informed regarding selection of their container for scanning as soon as they receive the communication in this regard by e-mail. (ii) On receipt of request from the Importer / Custom Broker, the Terminal Operator shall facilitate movement of these containers to the Container Scanner Facility for scanning. (iii) Containers selected for scanning, of marked SCANNED CLEAN on EIR copy by CSD, the Terminal Operator shall inform Importer / Custom Brokers, who can approach the DPD Facilitation Center and submit the said EIR Copy for the processing and printing of OOC. If the containers selected for scanning are marked SCANNED MISMATCH by CSI), the Terminal Operator shall move the mismatched containers to Designated CFS for 1000/0 examination and thereafter processing of OOC thereof. The terminal operator will also provide the copy of EIR document duly marked with container Scanning Facility officers in such cases to the Docks Examination Officer and Designated CFS who will reflect the same in Seal Cutting document raised by them. (iv) If the Container SCANNED MISMATCH on examination found to contain any discrepancy, the rest Of the containers in BOE shall be brought to the same CFS for further examination. 7. Procedure to be followed post scanning: 7.1 The Custodians of CFS shall provide the copy of EIR document duly marked by the container scanning facility officers for each container to the respective CFS Docks Examination Officers and reflect the same in the Seal Cutting Document raised by them. 7.2 The following examination norms shall be adopted for scanned containers at the respective CFS: (a) Containers with stamp SCANNED CLEAN on EIR: The Docks Examination Officers shall clear these Containers as per normal Customs Clearance / Examination Procedure. (b) Containers with stamp SCANNED MISMATCH on EIR: The Docks Examination Officers will examine such containers 100%. The results of examination of these containers shall be communicated by DC/AC (Docks Examination) to the DC/AC (Container Scanning Division). (c) Containers with stamp NOT SCANNED on EIR: Such Containers shall be examined by the Docks Examination Officers as per normal Customs clearance / examination procedures. The results Of examination of these containers shall be communicated by DC/AC (Docks Examination) to the DC/AC (Container Scanning Division). 7.3 If a container is not selected in the first scanning list for a particular IGM but gets selected after reaching concerned CFS on the basis of any amendment subsequently filed for that particular IGM, then such container shall be brought back for scanning to the Container Scanning Facility prior giving Out of Charge with the seal intact, Alternatively, DC/AC (Docks) may grant NOC from scanning but shall order for 100% examination at the respective CFS. 8.
