I am directed to invite your attention to minutes on Point No. 3 of the Modvat meeting held at Calcutta on 19-9-1990 regarding permission to remove inputs under Rule 57F(2). Trade had suggested that in case where there was a change in the job worker or an addition of a new job worker, the requirement of obtaining a fresh permission from the Assistant Collector, may not be insisted upon. The matter has been examined by the Board. In continuation of the instructions issued vide Board's circular No. 56/88-CX.8 (F.No. 267/ 150/88-CX-8), dated 31-10-88 whereby a general permission for each job worker was required to be given under Rule 57 F(2), it is directed that no fresh permission need be obtained by an assessee in case there is a change of the job worker. A manufacturer may simply send an intimation thereof the jurisdictional officer giving a reference of the original letter whereby initial permission was granted for such removal under Rule 57F(2).The acknowledgment of such intimation may be deemed to be the acceptance of the department and the assessee may be permitted to proceed ahead on such basis. Trade and field formations may be suitably informed.
