Overriding instructions of Risk Management System (RMS) in import - Customs - PUBLIC NOTICE NO. 01/24Extract OFFICE OF THE COMMISSIONER OF CUSTOMS ( IMPORT ) , MUMBAI ZONE III, PRO CELL, AIR CARGO COMPLEX , SAHAR, ANDHERI ( EAST ) , MUMBAI 400 099 e-mail- [email protected] Phone-022-22816696 Dated 03.01.2024 PUBLIC NOTICE NO. 01/24 SUBJECT : Overriding instructions of Risk Management System (RMS) in import Attention of all importers, trade, Customs Brokers and other stake holders and Officer are invited to the Circular No. 43/2005-Cus dated 24.11.2005. 2. Through this Circular RMS was introduced in import which is successfully functional since then. There has been immense development in the field of RMS algorithm. Further, the NCTC is also adding to the scientific targeting of consignments. 3. It has been noticed that a noticeable number of RMS facilitate Bill of Entries (B/Es) are interdicted locally, which defeats the purpose of introduction of RMS. The time taken in giving Out of Charge (OOC) in case of green channel B/Es from the time of registration doesn t reflect the full intended benefits of the green channel. 4. The para number 5 of the Circular No. 43/2005-Cus dated 24.11.2005 reads as:- It is possible that in a few cases, the field formations might decide to apply a particular treatment to the BE which is at variance with the decision received from the RMS owing to risks which are not factored in the RMS. Such a course of action shall however be taken only with the prior approval of the jurisdictional Commissioner of Customs or an officer authorized by him for this purpose, who shall not be below the rank of Addl./Joint Commissioner of Customs, and after recording the reasons for the same. A brief remark on the reasons and the particulars of Commissioner's authorization should be made by the officer examining the goods in the departmental comments in the EDI system . 5. Therefore, notwithstanding anything contained in any Public Notice, no variation from RMS instruction shall be done without express approval of the Commissioner of Customs (Import) in e-office in terms of the Circular No. 43/2005-Cus dated 24.11.2005. 6. The DC/AC (EDI) shall maintain a physical register where all the above mentioned permissions of the Commissioner of Customs (Import) for deviation shall be serially recorded and the serial number of the register shall be mentioned in the e-office file. The concerned Appraiser or Superintendent shall mention the serial number of the register besides the reasons of deviation in the ICES in terms of the referred Circular No 43/2005-Cus dated 24.11.2005. 7. The DC/AC (EDI) shall retrieve the data of all green channel clearances from ICES and reconcile the data with the register. It is the responsibility of the DC/AC (EDI) to reconcile the ICES data with the physical register and submit a reconciliation report to the Commissioner of Customs (Import) in e-office. 8. In case of any difficulty, the specific issue may be brought to the notice of the Additional/Joint Commissioner of Customs, Import, ACC, Mumbai (Email: [email protected]).
