Kind attention of Authorized Sea Carriers (Including Shipping Lines), Authorized Sea Agents (Steamers/Shipping Agents), Authorized Carriers (Transhippers), Terminal Operators, Custodians, Freight Forwarders, Importers, Exporters, Customs Brokers, Authorized Persons of all the above, Associations and Federations representing the above persons and all other concerned stakeholders is invited to the CBIC Notification No. 57/2024-Customs (N.T.) dated 31 August, 2024 vide which the transitional provisions of the SCMTR has been extended from 31 August, 2024 to 30th September, 2024 and the CBIC Circular No.12/2024-Customs dated 31 August, 2024 vide which the phase-wise implementation of the Sea Cargo Manifest and Transshipment Regulations (SCMTR) was fixed for Mangalore Customs (INNML1) w.e.f. 01.10.2024. Public Notice No.17/2024 dtd.03.09.2024, in this regard, was issued by this office. II. Registration/Application process to operate under New Sea Cargo Manifest and Transshipment Regulations (SCMTR), 2018 is open at ICEGATE Web Portal https://icegate.gov.in. Please login with your ICEGATE ID/Password to submit the application. Non-registered users can first register themselves as per Registration Advisories available under Downloads Section on ICEGATE website home page and the details of the application process has been given in the Technical Guide also available under Downloads Section on ICEGATE website home page. III. As a first step, the various stakeholders, will have to file an application to operate under the new regulations which is opened for all shipping lines, and have to apply in the same form. The application will have the details of the master applicant entity, persons authorized by them to work on their behalf, the various operations they intend to perform under the new regulations and supporting documents like address proof, contract/agreement, cases booked against them etc. IV. It is also informed that one of the first manifests which is being developed under the new regulations is the Customs Inland Manifest (CIM) which would cover the inland movement of any cargo. The CIM to be filed by the exporters availing the facility of e-Seal as per Board's Circular No.26/2017 dtd.01.07.2017 read with Circular No.36/2017 dtd.28.08.2017 has now been made operational. The CIM will have to be filed by the exporter just before the export cargo leaves the factory/premises of the exporter and would help in tracking the cargo till it reaches the port of export. The technical guidance on the SCMTR including the Customs Inland Manifest and the message format of CIM have both been uploaded on ICEGATE web portal for the benefit of the Trade. The CIM will have to be filed for each rail/truck carrying the cargo separately but can have cargo pertaining to multiple Shipping Bills. It is requested that exporters availing the benefit of e-Seal to: A. Obtain ICEGATE registration immediately, if not obtained already and submit application from their login to operate under the new regulations. B. Go through the technical guidance note and message format of the CIM and start filing the same. To assist the exporters, a downloadable Excel based utility has also been made available on ICEGATE. The exporters can use this utility to fill the required information for CIM and generate the required JSON file automatically which can be sent to ICEGATE by email at the designated email ID. C. Start filing the Shipping Bills in advance since the SB number has to be quoted in the CIM, which in turn has to be filed before the goods leave exporter's premises. V. Recently, it has been noticed that Errors are faced by the ASA while filing SAM/SDM and as ascertained from the DG System, it was informed that all the Authorised Shipping Agents (ASA) should necessarily be registered as an Authorised Sea Carrier (ASC) also, hence all the ASAS and ASCs working under the jurisdiction of Mangaluru Customs as parent registrant, but have not yet registered in SCMTR, are requested to register in SCMTR, immediately for smooth implementation of SCMTR w.e.f. 01.10.2024. Those ASAS and ASCs, working as child registrant and have not yet registered in SCMTR, are requested to get registered through their respective parent commissionerates. VI. The steps for registering as ASC in SCMTR by the parent entity are as follows:- a) After registering in the ICEGATE, the ASC should submit the following documents to the parent Customs Office requesting for allotment of Shipping Line Code (Advisory enclosed):- 1. Memorandum Article of Association. 2. Certificate of Incorporation. 3. Directors PAN Card/Passport Residential proof. 4. Company PAN Card. 5. Agency Agreement. 6. Office Address Proof. 7. Authorized Signatories. 8. Annexure I (Carrier Agency Registration Form) 9. Shop Establishment. 10. Board Resolution. 11. Port Registration Copy. b) After verification of the above documents, the System Manager will forward the details to DG Systems, ICEGATE, for allotment of the Shipping Line Code. c) After getting the Shipping Line Code, the ASC needs to visit ICEGATE website (https://www.icegate.gov.in/iceLogin/loginAction) and apply for ICEGATE ID registration, steps are detailed in the Advisory enclosed. d) The ASC should submit the online application in SCMTR within their login to transact under the new regulation (Advisory enclosed). The following documents are to be submitted to the Customs Office for verification:- 1. Application along with Form-I. 2. Copy of PAN Card of the Company and GST registration with Annex A B. 3. Copy of PAN Card and Aadhaar of each of the partners or directors (as per annexure B of GST Registration) of the company. 4. Copy of PAN Card, Aadhaar and educational qualification of the authorized persons. 5. Details of cases booked under Customs Act against the applicant, if any. 6. Self declaration that no cases are pending against the applicant under Customs Act, 1962- to be given on behalf of the company. 7. Self declaration that no cases are pending against the authorized persons under Customs Act - to be given by all the authorized persons. 8. Notarized copy of Contract/MOU/Agency Agreement entered into with the foreign authorizing agent. 9. Notarized address proof of company (lease agreement/telephone/water bill). 10. For ANC only:- Notarized Bond of Rs. 5 Lakhs in Form XI format and BG/NSC/FDR of Rs. 5 Lakh (BG in Auto-renewal format from a Nationalized Bank). e) After the online application is submitted successfully, the physical copies are to be submitted to the Customs office for verification and will be approved/defect notified/rejected by the Customs authority. Overview: Central Board of Indirect Taxes and Custom (CBIC) vide notification No. 38/2018-Cus (NT)dated 11.05.2018 read with notification No. 65/2018-Cus (NT) dated 30.07.2018 and 88/2018-Cus(NT) dated 30.10.2018 have notified Sea Cargo Manifest and Transhipment Regulations 2018, which shall come into force on 1st of March, 2019. This regulation supersedes the earlier regulations of Import Manifest (Vessels) Regulations, 1971, Export Manifest (Vessels) Regulation, 1976 and Transportation of Goods (Through Foreign Territory) Regulations of 1965. The new regulation stipulates changes in timelines and requirements for advance notice by shipping lines (vessels) arriving in India and Exports through shipping lines (vessels) out of India. The Indian Entity representing the Master of the vessel shall have to be registered with the Indian Customs to transact business under the new regulations and shall be called Authorised Sea Carriers (ASC). The agents acting on behalf of the Authorised Sea Carrier (ASC) shall be called as Authorised Sea Agents. As per the new regulations, the Authorised Sea Carrier (ASC)/Authorised Sea Agent (ASA) shall submit an Arrival Manifest electronically, prior to departure from the last port of call to the Indian Port of call. And submit a Departure Manifest electronically before departure from the Indian Port of call. The submission of Arrival and Departure Manifest shall have to be complied with by the ASC/ASA before departure from the last port/customs station of call to every Indian customs station and Departure then on respectively. The salient changes are as hereunder: Covers reporting of all cargo in the ship rather than import/ export cargo (coastal cargo, same bottom cargo) Seeks additional details about every cargo reported (invoice value, HSN etc.) Time of reporting is advanced to the port of departure Ensures track and trace of the cargo reported Includes features necessary for movement of vessel within India Electronic capture of details sought manually through paper (Crew List etc.) Online Application for Entry Inward Enhanced, Real-time information exchange 2. Process Involved 3.1 Proposed Process Flow The process flow can be understood by the flowchart as below: 3.2 Registration Under the new regulations the Person acting as Authorised Carriers (Authorized Sea Carrier, Authorised Transhipper), Authorised Sea Agent, Custodian, Terminal Operator shall have to be approved afresh by the proper officer. The Approval is completely online and faceless. The Application needs to be submitted online through ICEGATE Portal. If the user has not signed up for ICEGATE Registration, the same shall be completed at earliest. ICEGATE Registration: For registration, every new user shall have to go to the ICEGATE Portal at https://www.icegate.gov.in and signup. The new users are requested to please go through the registration advisory and registration demo that will assist in registration and obtaining login ID for all the Authorised persons. Child Registration for Authorised Persons: Every individual authorized to carry out operations under the regulation should be registered as Child user of the Entity registered. For e.g A Shipping Line company is registered as Master and transacts through ICEGATE Portal. All the individuals authorized as signatories to carryout operations should be registered as Child user of the above Master, if not already done. Application Under Regulations: Once registered, the users will have to submit the online application (Pl see Annexure 1) with in their login to transact under the new regulations. The same application shall also have to be submitted by the existing ICEGATE users. For different role, the separate application needs to be filed with different Entity Type. The user shall choose the Port/Customs station where he wishes to submit the application electronically. The Master Login holder shall have to add the details of all the Authorised persons for this purpose and vouch for the details. The various guidance notes and FAQs will assist and enable them in their interaction with Indian Customs further. The cases pending against and/or action taken under the Customs Act shall have to be mentioned in the application. The relevant supporting documents shall have to be uploaded on e-SANCHIT and referenced in the application. 3.2.1 Interaction in the New Scenario: Registration Application to Operate Before applying for Authorised Sea Carrier, the ICEGATE login ID shall have to be obtained for each Authorised person that the firm/company wishes to be included in the registration. The steps are as follows: Step 1 : Login/sign up to the ICEGATE Portal. Step 2 : After logging in, click the option Apply for Authorised Sea Carrier . Step 3 : The form as given in Annexure 1 shall appear. Step 4 : In Entity Information, choose the Port of Registration from where you wish to get approved. While filling this field, keep in mind that for registration of Authorised Sea Carrier (ASC), Authorised Sea Agent (ASA), Authorised Transhipper (ATP), Authorised Terminal Operator the port should compulsorily be a sea port and hence the LOCODE should end with 1. (ex. INNSA1 for Nhava Sheva Sea Port). For, Custodian and Authorised Exporter for e- seal any LOCODE is permissible, depending on their port of operation. If applicable, give the Authorised Economic Operator (AEO) Number. Contact information like landline number, mobile number and email id shall be verified by OTP verification/other methods. Step 6 : In Authorised Operations, the information for all the company operations in India are to be furnished. Option of Add/Delete shall be provided for each separate operation. Various operation type codes elaborated below along with the description of other fields. Seq. No. start with 1 and use the option of Add/Delete for each additional operation (ex. If you have 5 in India then the sequence No. will be from 1 to 5) Type the codes permitted are SL Shipping Line, SA Shipping Agency, CT Custodian, TO Terminal Operator, CI Custodian ICD, CC Custodian CFS, IEB IEC Branch Commercial Code Code assigned for such operation in Customs Systems. For Eg. Shipping Line code, Steamer Agent Code etc. Multiple Codes allowed. An Entity acting as sole representative for multiple Shipping Lines can provide multiple codes. Contract would be uploaded in e- SANCHIT and referenced. (For IEC + the branch code the range of which is from 000 to 999. Therefore, the field length shall be ( + 001 to 999 ), so up to 13 characters) GSTIN No. GSTIN of the operation. (Custodian may have operations at multiple states and hence GSTIN may differ) Latitude, Longitude the GPS coordinates may be furnished here for the branch address. A GPS mobile app (ex. Google maps) may be used for obtaining and furnishing the latitudinal and longitudinal coordinates up to 6 places of decimal. The longitudinal coordinate should begin with 0. (+DD.DDDDDD/+0DD.DDDDDD(ex. The coordinates for Samrat Hotel in Chanakyapuri, Delhi are +28.596738/ +077.197718) Expiry date Expiry date of the license to operate/may be left blank provided where applicable. (E.g. Shipping Line Contract Expiry Date) Step 7 : In Authorised Persons section, each person that you wish to Authorize as a representative of the firm is to be furnished. Use the Add/Delete option to add or delete each time. Sequence number can be given for each person. The PAN here has to be the personal PAN of the person. Furnish the Address, Date of Birth and contact information like landline, mobile number and email. Please note that the Entity shall vouch for the information so furnished for each of the persons that are added here. The Address Proof and ID proof Type may be mentioned, scanned copies of which shall have to be uploaded on e-SANCHIT for verification. Please note that each of the authorized persons shall also have to obtain registration with ICEGATE and their ICEGATE ID shall be quoted by the master in the application. Step 8 : Upload the scanned copies of the documents on e-SANCHIT (ex. ID proof, MoU in case of Foreign User, Customs cases booked, if any). In case there are no Customs cases booked against the applicant, a self-certified declaration to that effect, duly signed by an authorized person will have to be uploaded. Step 9 : After uploading the scanned copies of the documents in step 8, fill the details in the application form with regards to the same. The data fields are explained as below: Seq. No. give the sequence of the document uploaded Section give the code of the section to which the uploaded document pertains. For Entity Information the section code is M, for Authorised Operations O and for Authorised Persons P. For eg., when uploading document with regard to the Customs Cases booked, the Section Code should be M. The codes for all the document types along with the corresponding reference section codes are given in Annexure 5 Section Sequence Number will be the same as the sequence number of the Authorised Operation/Person whose document it is. For Entity Information the sequence number shall be 0. IRN Image reference number from e-SANCHIT Doc. No. The identification/reference number on the document Doc. Code Document type code. The Codes for the document type code are given in annexure 5. Doc. Beneficiary Code Code of the beneficiary firm/entity, (in this case, PAN Number of the Master) Expiry date The expiry date on the document if applicable/may be left blank where applicable Step 9 : After the verification of all the details click Submit. On successful submission of the application, the same would get reflected on your dash- board. In case of error, there will be an option to rectify and resubmit. The application will be communicated to the Jurisdictional Officer for verification automatically and the status application pending approval will be reflected on your ICEGATE dash-board. In case there is a query raised by the Jurisdictional officer, the queries will be communicated on your ICEGATE dashboard. Option of modifying the application is available in which case you can choose A (Amendment) from the drop down of the message type field and furnish the reply to the queries. As and when Jurisdictional Officer approves the application, you shall be informed via SMS for the same. On approval, you can start operating under the New Regulations. To summarise, the electronic message exchange between the different stakeholders during registration is illustrated as given hereunder: 3.3 Sea Manifest 3.3.1 Process Change The following table juxtaposes the current scenario with the process that shall come into being after the implementation of the new regulations. CIM CIMD Amendment amendment, if any, shall be delivered ATD Actual Time of Departure he Actual time of departure from the port shall be given by the Custodian/Customs officer at the Gateway port and shall communicate the same to the Inland Customs Station. NRA Notification regarding Arrival the gateway port Custodian shall deliver the message of Notification regarding arrival to the Custodian at the destination station that the container shall arrive and communicate the CIM number. ESN E-Seal Departure Notification the e-seal movement notification is messaged to Customs after the departure of the truck from Exporter Premises. ATA Actual Time of Arrival on Arrival of the Truck/Train the officer/custodian at the land customs station shall send the message of the actual time of arrival to the gateway port custodian. CIMA CIM-A the officer shall check the container and note the condition in which the container has arrived. In case the container arrives in acceptable condition i.e. no tampering has been observed, the container status message shall be sent to the gateway port. The Inland Arrival Manifest shall be messaged to the land Customs station by the Custodian/Transhipper after arrival. 3.4.3 Data Structure The relationship of the data fields is as given below: 3.5 Referencing Cargo Manifested: It is envisaged that the cargo manifested would be consolidated/segregated at different stations before import or export process is completed. Hence, it is imperative that Every Cargo manifested should be uniquely identified, so as to keep track of the movement of the cargo. The System would generate a unique number called Sub-Manifest Transhipment Permit (SMTP) for any cargo manifested for inbound or outbound customs movement. The SMTP corresponds to a transport document issued to a shipper for a carriage of cargo. The Concept of SMTP referred above is slightly different from present context. Currently, SMTP number is assigned for a Transhipment request by a custodian in the manifest. It could include multiple lines being transhipped rather than a cargo. This posed difficulty in capturing consolidation or segregation of a cargo in customs premises. In this scenario, any cargo manifested for landing into a customs area would be assigned a unique number if not already identified uniquely by customs such as Shipping Bill etc. 3.5.1 Consolidation or Segregation of a Cargo: When there is a consolidation or segregation of a such cargo, the option would be available to capture the modified packaging details. This would help in tracking of a cargo, while minimizing the mismatch between declarations filed by various stakeholders. Annexure 1: Registration Form 1. SDM-Sea Departure Manifest Deliver the Sea Departure Manifest after before departure at the port of call SDA -Sea Departure Amendment where an amendment is required to SDM DN Departure Notification - the ASA/ASC will give the DN. Sail report by the officer shall freeze the departure manifest. No amendment shall be allowed after this. To be Filed by Terminal Operator of the Port: ATA - Actual Time of Arrival after the vessel has arrived the Terminal Operator shall give the actual time of Arrival giving information for the fields that are in the ATA Form CLA Container Landed on Arrival after the officer enters the entry of the vessel in the system, the offloading of the cargo can take place. The Terminal Operator shall give the container details and the number of containers landed. The time when the offloading is completed is also furnished at this time. CLD- Container Loaded-Departure - if there is any cargo that has to be carried by the vessel, the loading shall take place and after the completion of loading the Terminal Operator shall give the CLD form in which the container details will be given and the time of completion of loading shall also be furnished. In the meantime, the vessel shall file the Sail Notification. If there are any amendments to the Departure Manifest, those shall be filed by the shipping line. The officer shall acknowledge the same. ATD Actual Time of Departure on departure of the vessel the terminal operator shall file the ATD. In which the actual time of departure shall be furnished. The officer at the Port shall give the Entry Inward and SMTP would be generated, if applicable. Similarly, on the Departure, Sailing Report would be approved by the officer. What is Sea Cargo Manifest and Transhipment Regulations (SCMTR), 2018? The Sea Cargo Manifest and Transhipment Regulations (SCMTR), 2018 have been issued under statutory provisions of the Customs Act, 1962. The regulations seek to bring about transparency, predictability of movement, advance collection of information for expeditious clearance. This Regulations supersedes the earlier regulations viz. Import Manifest (Vessels) Regulations, 1971 and Export Manifest (Vessels) Regulation, 1976. The new Regulations stipulate for advance notice by authorized carriers for goods arriving in or being exported out of India through gateway sea ports. It stipulates the obligations, roles and responsibilities for the various stakeholders involved in movement of customs cargo. As per details in Message Implementation Guide, following stakeholders would require registration,- 1) Authorised Sea Carrier (Including Shipping line) 2) Authorised Sea Agent (Steamer/ Shipping Agent) 3) Authorised Carrier (Transhipper and other notified carriers) 4) Terminal Operator 5) Custodian Q3. Is the SCMTR application required to be filed by the stakeholders separately for each location they operate from? Only one registration needs to be taken for one entity for each of its type of operation (ASC/ASA/ATP etc.). The application will be filed only by the master entity and will be available only in its login for viewing or amending. While the port of registration will have to be specified in the application form for the purpose of its approval by Customs, the entity will be free to operate from any other port in that entity type. Each of the branch offices can get separate ICEGATE ID as a child user of the Master entity. Master applicant specifically gives branch office details in his SCMTR application. Q4. If I am already registered with ICEGATE and have an ICEGATE ID, do I still need to apply afresh for SCMTR, 2018? In order to comply with the new regulations, a separate online application has been made available with the ICEGATE login for all the concerned stakeholders. Therefore, every stakeholder who is either obligated or intends to operate under the new Regulations shall submit registration application from his ICEGATE login. The Declaration is to be submitted to Customs by the declarant electronically through ICEGATE by using Simple Mail Transfer Protocol (SMTP) or Web upload (For more details, refer Link: https://icegate.gov.in/com_guideline.html). Q17. Do I get an acknowledgement on successful filing of declaration? Every submission by the declarant will be acknowledged (either with success or with error codes). Q18. What are the different types of validations by the Customs System for the submitted declarations? Is there a reference list for the various possible errors? Each declaration will be validated by the Customs System for the consistency of its format and data integrity. What is Arrival Manifest? The Arrival Manifest means an integrated declaration required to be delivered by an authorised carrier before or on arrival of, (i) the vessel carrying imported goods, export goods, or coastal goods or(ii) a train or a truck carrying imported goods or export goods. Q20. What are the timelines for filing Sea Arrival Manifest (SAM)? The general declaration and cargo declaration for SAM will be required to be filed before the vessel leaves the last port of call except for non-containerized cargo. For non-containerized cargo SAM should be filed before arrival of vessel at the Indian port. Application for entry inwards, vessel stores and crew/passenger list have to be submitted just before the arrival of the vessel at the port. This declaration will be referred to by the acronym SEI. Q21. What is the first step in the process of filing an arrival manifest? While filing an arrival manifest, the Authorised Sea Carrier will be required to quote the Voyage Call Number (VCN) for the vessel, among other things. VCN is a unique number assigned for every voyage of any vessel by the respective port of call. Thus, VCN being the reference identifier for every voyage carrying goods into Indian ports, is a prerequisite for filing the arrival manifest. Q22. Once the VCN is available, will the arrival/departure manifest be required to be filed by the Authorised Sea Carrier as a single event? Under the new Regulations, option is available with the Authorised Sea Carrier (ASC) to declare all the cargo in a single event as arrival/departure manifest. ASC can also prepare the arrival/departure manifest by aggregating Cargo Summary Notification (CSN) filed separately by other Authorised Carrier. Q23. What is CIN and how is it generated? CIN is a unique identification number assigned by Customs System to every cargo declared. In order to account for every consolidation and segregation of cargo seamlessly, two types of CIN would get generated: PCIN Primary Cargo Identification Number It is the identification number assigned by Customs automated System to uniquely identify a cargo contained in single Transport Document (like Bill of Lading) mentioning Actual Buyer and Seller in imports. In exports, a PCIN corresponds to cargo covered under a single Shipping Bill. Having a PCIN for every cargo facilitates smooth filing of different declarations and removes duplicate filing effort, thereby simplifying the processes. MCIN Master Cargo Identification Number Since multiple cargoes can get consolidated under a consolidated Bill of Lading (BL), MCIN is the identification number assigned by Customs automated System for all the cargo covered under a consolidated BL. Each MCIN will be an aggregation of multiple PCINs. Referring to an MCIN in any subsequent manifest would mean reference to all the underlying PCINs. Q24. What is Departure Manifest? The Arrival Manifest means an integrated declaration required to be delivered by an authorised carrier before or on arrival of, (i) the vessel carrying imported goods, export goods, or coastal goods or(ii) a train or a truck carrying imported goods or export goods. Q25. What are the timelines for filing Sea Departure Manifest (SDM)? What is meant by Sea Departure Notification (SDN)? SDM is the manifest required to be filed by Authorised Sea Carrier before departure of the vessel from any Indian sea port. SDN is the declaration having final summary of the cargo actually carried by the vessel. SDN is filed by the Authorised Sea Carrier after the departure of the vessel within 24 hrs of the departure of the vessel for containerized cargo and 72 hrs for other cargo. Q26. What are the list of messages involved in Arrival and Departure Manifest filing? Q27. Can the declarations (SAM and SDM) be amended after filing? What are the timelines for the same? Both SAM and SDM can be amended after filing. In case of SAM, amendments will not require any approval by the Customs officer if filed within following timelines: Short Haul Voyage (expected arrival less than 48 hrs) 6 hrs before expected arrival Medium Haul Voyage (expected arrival 48 96 hrs) 24 hrs before expected arrival Long Haul Voyage (expected arrival after 96 Hrs) 48 hrs before expected arrival If the amendments are filed beyond the above timelines, they will require approval by the proper officer. Such amendment approval will be given online. In case of SDM, the amendment can be filed any time before SDN is filed. Q28. What will happen if declaration is not provided to Customs within prescribed timelines? Regulation 13 provides for a penalty which may extend to rupees fifty thousands for contravention of any provisions of these regulations. Q29. Do I need to declare details pertaining to empty containers in my manifest? Yes, empty containers will also have to be declared in the manifest as a part of equipment details with equipment status as Empty. Q30. What is CSN and who can file it? CSN stands for Cargo Summary Notification. It is the declaration filed with Customs regarding the details of cargo covered under a Transport Document (viz. Bill of Lading). The CSN can be filed by any notified party including Freight forwarders, NVOCC, consolidator etc. who are party to that Transport Document. On successful submission of this declaration, a unique CSN number would be generated that will act as a reference number for the next declaration by the consolidator or the vessel operator (VOA). Q31. Once the CSNs are filed by the respective parties, who will be responsible to file the arrival manifest? Under the new Regulations, the responsibility to file the arrival manifest lies solely on the Authorized Sea Carrier, i.e. the vessel operator or the VOA. The vessel operator, however, can reference the previous CSN declarations, if any, filed by the consolidators for the cargo being undertaken in a voyage. Q32. Where can I find the guidelines and technical document on the Cargo Summary Notification and the Arrival Manifest? The technical guidelines including the Message Implementation Guidelines (MIG) are available on the ICEGATE website (https://www.icegate.gov.in/SeaManifestRegulation.html). Q33. Can the CSN be filed only by the other notified parties like freight forwarder or consolidator? A CSN can be filed not just by the other notified parties but also by the vessel operator. A vessel operator can file CSNs for every transport document if it has the necessary details and just refer the CIN numbers in the final arrival manifest. Q34. Can I get an illustration on arrival reporting under SCMTR, 2018 which comprises of one freight forwarders and one vessel operator? A. The Vessel operator will apply for VCN (Voyage Call Number) which will be assigned by port authorities B. CSN can be filed by the Freight forwarder by quoting just the Master BL issued by the vessel operator and giving details of the House BL issued by him to the importer/exporter. A PCIN would be generated by the Customs Automated System and communicated to the Freight forwarder for the cargo covered in the House BL. C. Alternatively, Vessel operator can also file CSN if details have been provided by the Freight forwarder. D. The CSN Numbers can be given to the vessel operator who will file the Sea Arrival Manifest. E. MCIN will be generated against the master Bill of Lading declared by the vessel operator. Q35. In case of the same information being furnished by different stakeholders, say a freight forwarder and the vessel operator, which one will be considered? A CIN Number is assigned to cargo covered under a BL primarily so that it can directly be referred by the next level consolidator. Once the cargo levels details have been furnished for a BL by the concerned freight forwarder, the consolidator or the vessel operator will not be able to give details for the same BL again. Q36. Is CSN filing by freight forwarders or consolidators a mandatory requirement for filing the Arrival Manifest? A CSN is only a facilitative measure using which the freight forwarder or the consolidator having the actual details of the cargo (or the B/L) can file the declaration directly with Customs without having to share these with any other entity including the vessel operator. However, the freight forwarder is at liberty to not file the CSN and provide all the necessary cargo details to the vessel operator to directly file in the arrival/departure manifest. Q37. Who will file declarations in case the vessel is being operated by different slot operators under a vessel sharing agreement ? The person obligated to act as a Vessel operator under the commercial contract will also act as the Authorized Sea Carrier for the purpose of filing Arrival and Departure manifests. Q38. What is Transhipment under Regulation 7? Transhipment under the Regulation 7 refer to any movement of Customs cargo between two Customs areas. Q39. Who is a Transhipper? What are the responsibilities of a Transhipper? The person responsible for the movement of the import/export goods within India is a Transhipper. There would be only one authorized Transhipper responsible throughout the movement of the transhipped cargo, irrespective of the modes of transport. The Transhipment Bond will also be executed by the authorized Transhipper. For filing declarations under the new regulations, a transhipper should get registered in the category of ATP. Pl refer answers to Q No 2 to 7 for details on registration and application process. Q40. If an entity is working as a Custodian as well as a Transhipper, does the entity need to take multiple registrations? There are different manifests/declarations required to be filed by Transhipper and Custodians. If a Custodian is acting as a Transhipper, while the ICEGATE registration or ICEGATE ID will remain the same, two different applications will have to be made under the category as ACU and ATP. Q41. What is the procedure for transhipment of goods? The authorized trans shipper will have to file arrival and departure manifests for every stage of the inland movement of the cargo. The manifests pertaining to the transhipment are labelled as Customs Inland Manifest (CIM) Arrival (AR)/ Departure (DP). The manifest will have to be filed for every vehicle (truck/train) carrying the cargo upto and between inland customs areas. Q42. When CIM is required to be filed? The authorized carrier will have to file arrival and departure manifests before departure and upon arrival of the conveyance at the respective Customs areas. Q43. Do the stakeholders need to provide the entire data afresh in subsequent transhipments or the information provided in the manifest covering the earlier leg of the cargo movement can be referenced to? While a declaration will have to be filed before departure and upon arrival of the conveyance at the respective Customs areas, the declarant will be able to link the declarations made in the previous manifests for every cargo using the cargo identification number (CIN) assigned to the cargo. Q44. Is there requirement of executing a fresh bond for carrying imported of export goods during in-land movement? No fresh bond is required to be executed. However, the person responsible for the movement of the import/export goods within India may execute a National Transshipment Bond which is managed by Customs Automated Systems. Q45. What are the responsibilities of an Authorised carrier in case of transshipment of goods? Authorised Carrier shall file a Departure/Arrival manifest in prescribed form for imported or export goods in terms of Regulation 7. Q46. What are other declarations to be filed to comply with the requirements under SCMTR? Stuffing and stripping reports are required to be filed electronically by the Custodians including Terminal Operators wherever the cargo is being segregated or stuffed in different containers. Custodians can submit these declarations through the ICEGATE MFTP with ICEGATE ID. In case any Custodian has not on-boarded the ICEGATE MFTP, they can approach the concerned System Manager of Customs for forwarding the prescribed application to ICEGATE. Stuffing (SF) and Stripping (ST) messages will be filed for every equipment (container) giving the PCINs/MCINs being stuffed into or stripped out of that container. Additionally, Custodians will also have to file notifications of actual time of arrival and departure of conveyance (ATE/ELR for Terminal Operators and AT/DT for other Custodians). Message structure is available in Message Implementation Guidelines. Q47. Is there any field in the Manifest for identification of cargo pertaining to AEO importer/exporter? The new manifest format also includes declaration of the IEC/PAN of importer/exporter. This will enable the Customs System to identify the AEO clients and accord facilitation in terms of extant provisions. Q48. Is there any relaxation for AEO status holders operating as an entity under SCMTR? As per Regulation 3 (1A), AEO is not required to furnish any Bank Guarantee while other entities need to furnish Bank Guarantee for an amount of Rupees Ten Lakhs. Further AEO has the facility of extended period of registration after initial three years. Q49. Is there any simple data entry tool/utility available to prepare the declarations in the specified format? The declarants are free to use their own IT infrastructure or any other private software for preparing and filing the required declarations. However, simple data entry utilities have also been made available on the ICEGATE website (https://www.icegate.gov.in/SeaManifestRegulation.html) which can be used to generate message files in the required JSON format. The file can then be signed digitally and sent through designated channels. In addition to the above, a free digital signing utility is also available on ICEGATE website for the benefit of the users. (https://www.icegate.gov.in/digitalSign/digitalSign.html). Q50. Is there any helpline available for resolution of queries or technical issues faced during registration or filing? Introduction: Central Board of Indirect Taxes and Custom (CBIC) have notified Sea Cargo Manifest and Transhipment Regulations 2018, which shall come into force from 01 August 2019. The new regulation stipulates changes in timelines and requirements for advance notice by shipping lines (vessels) arriving in India and Exports through shipping lines (vessels) out of India. As per the new regulations, the Authorised Sea Carrier (ASC)/Authorised Sea Agent (ASA) shall submit an Arrival Manifest electronically, prior to departure from the last port of call to the Indian Port of call. And submit a Departure Manifest electronically before departure from the Indian Port of call. SCMTR Introduces: Arrival Manifest in place of IGM Departure Manifest in place of EGM Arrival Transhipment Manifest in place of SMTP Departure Transhipment Manifest in place of Truck Summary Arrival Manifest (AM): Mandatory rule of Arrival Manifest to be filed in customs before vessel getting departed from Last foreign port of call. Example for Galex westbound, Port Klang is the last foreign port of call. For all containers going to discharge for local or discharge for transhipment at any Indian Ports. Harmonized (HS) Code of 8-digit is mandatory for Arrival Manifest to customs Departure Manifest (DM): Mandatory rule of Departure Manifest must be submitted to India Customs Prior Sailing of vessel from Port of Loading in India Applied for all containers loaded on said vessel at Indian Ports. 2. Registration Process: Under the new regulations the Person acting as IEC Holders, Authorised Carriers (Authorized Sea Carrier, Authorised Transhipper), Authorised Sea Agent, Custodian, Terminal Operator, Authorised Notified Carrier shall have to be approved afresh by the proper officer. The Approval is completely online and faceless. The Application needs to be submitted online through ICEGATE Portal. Before SCMTR registration, every user shall have to register at ICEGATE and obtain an ICEGATE ID. The new users are requested visit at www.icegate.gov.in and go through the registration advisory and demo that will assist in registration and obtaining login ID for all the Authorised persons. Child Registration for Authorised Persons: Every individual authorized to carry out operations under the regulation should be registered as Child user of the Entity registered. For e.g. A Shipping Line company is registered as Master and transacts through ICEGATE Portal. All the individuals authorized as signatories to carryout operations should be registered as Child user of the above Master, if not already done. Application Under SCMTR Regulations: Once registered, the users will have to submit the online application within their login to transact under the new regulations. The same application shall also have to be submitted by the existing ICEGATE users. For different role, the separate application needs to be filed with different Entity Type. The Master Login holder shall have to add the details of all the Authorised persons for this purpose and vouch for the details. The various guidance notes and FAQs will assist and enable them in their interaction with Indian Customs further. The relevant supporting documents shall have to be uploaded on e-SANCHIT and referenced in the application. Interaction in the New Scenario: Registration Application to Operate Before applying for SCMTR registration, the ICEGATE login ID shall have to be obtained for each Authorised person that the firm/company wishes to be included in the registration The steps are as follows: Step 1 : Login/sign up to the ICEGATE Portal. Step 2 : After logging in, click the option Application For SCMTR . Click on New Registration option for fresh SCMTR registration If the user is other than parent users of Shipping line, Shipping Agent, IEC Holder, Custodian or Console Agents then they would be unable to access the form and the similar message will get displayed on the screen. Step 3: The form as shown below shall appear for the parent users of Shipping line, Shipping Agent, IEC Holder, Custodian and Console Agents Step 4: In Entity Information, choose the Port of Registration from where you wish to get approved. While filling this field, keep in mind that for registration of Authorised Sea Carrier (ASC), Authorised Sea Agent (ASA), Authorised Terminal Operator (ATO) and Authorised Notified Carrier (ANC) the port should compulsorily be a sea port and hence the location code should end with 1. (ex. INNSA1 for Nhava Sheva Sea Port). For Authorised Transhipper (ATP) and Authorised Exporter for e-Seal (AES) any location code is permissible, depending on their port of operation. For Authorised Custodian (ACU), any one of the ports from where the user is operating will be selected. If you have 5 in India then the sequence No. will be from 1 to 5)Type: The codes permitted are SL Shipping Line, SA Shipping Agency, CT Custodian Terminal Operator, CI Custodian ICD, CC Custodian CFS, IEB IEC Branch, CA Console Agent Commercial Code: Code assigned for such operation in Customs Systems. For E.g. Shipping Line code, Steamer Agent Code etc. Multiple Codes allowed. An Entity acting as sole representative for multiple Shipping Lines can provide multiple codes. Contract would be uploaded in e-SANCHIT and referenced. (For IEC + the branch code the range of which is from 000 to 999. Therefore, the field length shall be (+), so up to 13 characters). The Commercial Code for Custodians (ATO, ATP and ACU) would be a 10-character code which would comprise of the location code and the custodian code. The Commercial Code for Console Agent (ANC) would be the PAN of the entity. GSTIN No.: GSTIN of the operation. (Custodian may have operations at multiple states and hence GSTIN may differ) Latitude, Longitude: The GPS coordinates may be furnished here for the branch address. A GPS mobile app (ex. Google maps) may be used for obtaining and furnishing the latitudinal and longitudinal coordinates up to 6 places of decimal. The longitudinal coordinate should begin with 0. (+DD.DDDDDD/+0DD.DDDDDD(ex. The coordinates for Samrat Hotel in Chanakyapuri, Delhi are +28.596738/ +077.197718) Expiry Date Expiry date of the license to operate/may be left blank provided where applicable. (E.g., Shipping Line Contract Expiry Date). Step 6: In Authorised Persons section, each person that you wish to Authorize as a representative of the firm is to be furnished. Use the Add/Delete option to add or delete each time. Sequence number can be given for each person. The PAN here has to be the personal PAN of the person. Furnish the Address, Date of Birth and contact information like landline, mobile number and email. Please note that the Entity shall vouch for the information so furnished for each of the persons that are added here. The Address Proof and ID proof Type may be mentioned, scanned copies of which shall have to be uploaded on e-SANCHIT for verification. Please note that each of the authorized persons shall also have to obtain registration with ICEGATE and their ICEGATE ID shall be quoted by the master in the application. Step 7: Upload the scanned copies of the documents on e-SANCHIT (ex. ID proof, MoU in case of Foreign User, Customs cases booked, if any). In case there are no Customs cases booked against the applicant, a self-certified declaration to that effect, duly signed by an authorized person will have to be uploaded. Step 8: After uploading the scanned copies of the documents in step 7, fill the details in the application form with regards to the same. All the users have to upload a mandatory Self- Declaration Document on custom cases by selecting section M from the dropdown and entering the section sequence number as 0 . The document type of the mandatory self-declaration document would be 022CO1 . The data fields are explained as below: Seq. No.: give the sequence of the document uploaded Section: give the code of the section to which the uploaded document pertains. For Entity Information the section code is M, for Authorised Operations O and for Authorised Persons P. For e.g., when uploading document with regard to the Customs Cases booked, the Section Code should be M. The codes for all the document types along with the corresponding reference section codes are given in the Annexure 1. Section Sequence Number: will be the same as the sequence number of the Authorised Operation/Person whose document it is. For Entity Information the sequence number shall be 0. IRN: Image reference number from e-SANCHIT Doc. No.: The identification/reference number on the document Doc. Type: Document type code. The Codes for the document type code will be given in the Annexure 1. Beneficiary Code: Code of the beneficiary firm/entity, (in this case, PAN Number of the Master) Expiry Date: The expiry date on the document if applicable/may be left blank where applicable. Note : All the Shipping Line (Entity Type - ASC) users registering for SCMTR have to upload MoU for each Authorised Operation and the details of the same have to furnished in Supporting Documents tab. The Section would be O and the Document Type of the same would be 149SL1. Step 9: After the verification of all the details click Submit. On successful submission of the application, the same would get reflected on your dashboard. In case of error, there will be an option to rectify and resubmit. The application will be communicated to the Jurisdictional Officer for verification automatically. Amendment in SCMTR Registration In SCMTR Application, users will be given option to amend their application details. The option for amendment will only be enabled after the SCMTR application has been successfully submitted by the user. The user s SCMTR dashboard will show the Edit link under the Amendment column. The user can change every detail in the application except the Entity Type and Entity Pan. The user after making the changes will again need to submit the application by generating the OTPs. Points to Note 1. ASC is the Main Line Operator. The Indian offices of the foreign shipping line may operate as Authorised Sea Carriers. Any agent employed by the Authorised Sea Carrier to act on his behalf shall be registered as Authorised Sea Agent. 2. If a user is already registered on ICEGATE as a shipping agent, he can apply as Authorized Sea Carrier in the SCMTR application directly using his existing ICEGATE login. 3. Shipping Lines need not again register separately as ANC or ATP. Only Transhipment bond has to be given separately at the port of registration to operate as Transhipper also. 4. For ACU operating at multiple locations, ICEGATE registration can be taken for the master entity at one of the location. While filing the SCMTR application, details of other locations/custodian codes can be given under Authorized operations. 5. ACU is such person approved as Custodian by the Commissioner of Customs section 45 of the Customs Act 1962. For more details on SCMTR related matters, kindly refer the FAQs here. Madam/Sir, Subject: Implementation of the Sea Cargo Manifest and Transhipment Regulations. Kind reference is invited to Notification No.38/2018-Customs (N.T.) dated 11.05.2018 vide which the Sea Cargo Manifest and Transhipment Regulations (SCMTR), 2018, were notified. The SCMTR seek to bring about transparency, predictability of movement, advance collection of information for expeditious clearance and supersedes the earlier regulations viz. Import Manifest (Vessels) Regulations, 1971 and Export Manifest (Vessels) Regulation, 1976. The new Regulations stipulate for advance notice by authorized carriers for goods arriving in or being exported out of India through gateway seaports and further movement between Customs stations. They stipulate the obligations, roles and responsibilities for the various stakeholders involved in movement of imported/export goods. Based on the feedbacks from the various stakeholders, the changes were incorporated and the said regulations was made effective from 1st of August, 2019 with transitional provisions under Regulation 15 till the 30th of September, 2020. 2. Considering the disruptions caused due to Covid-19 Pandemic and non-readiness of the stakeholders, Board has issued Notification No.94/2020-Customs(N.T.) dated 30.09.2020, vide which the transitional provisions under Regulation 15(2) have been extended from 1st October, 2020 till 31st March, 2021 to enable submission of manifests under erstwhile regulations. However, as per Regulation 15(1), mandatory filing of different declarations in new format in a phased manner is provided for as per the annexure A to this circular. Different timelines are prescribed so that trade has sufficient time to comply with the new regulations in a phased manner. Further, vide Regulation 15(2), the mandatory compliance requirements for submissions of declarations and manifests under the said regulations shall applied in full effect from 1st April, 2021. 3. Another procedural relaxation is that the amount of bond and bank guarantee or postal security or National Savings Certificate or fixed deposit, as required under Regulation 3(1A) has been reduced to Rs 5,00,000 /- from Rs 10,00,000 /-. It is also informed that vide the above stated Notification No. 94/2020-Customs(N.T.) dated 30.09.2020, in addition to Authorised Economic Operators (AEOs), Customs Brokers who are already licensed under the Customs Brokers Licensing Regulations, 2018, who are authorised to issue delivery orders, are also exempted from the requirement to furnish a fresh bank guarantee or postal security or National Savings Certificate or fixed deposit , under proviso to Regulation 3(1A) of the SCMTR. 4. It is informed that Directorate General of Systems has taken several measures for handholding the trade and all stakeholders for smooth transition to the SCMTR regime. Directorate General of Systems has issued various guidelines related to the registration process and filing requirements under the new Sea Cargo Manifest and Transhipment Regulations (SCMTR) for different stakeholders such as Shipping Lines, Freight Forwarders, Transhippers etc, who are integral to the implementation of the said regulations. The guidelines can be found at the following link (https://www.icegate.gov.in/SeaManifestRegulation.html). For the sake of guidance and clarity, the procedural compliance requirements of the said regulations is reiterated in the following paragraphs. Registration of Stakeholders: 5. The registration of different stakeholders stipulated in regulation (1) of the SCMTR is a completely automated process through ICEGATE Portal. The detailed guidelines available at https://icegate.gov.in/Download/Advisory_for_users_on_SCMTR_v2.0.pdf may be referred to for more clarity on the registration process. It is noticed that while a sizeable number of stakeholders have registered successfully on ICEGATE, there remains a significant number who are yet to be onboarded due to lack of reciprocity, despite various advisories. Board urges all the stakeholders to immediately register on ICEGATE and apply from within their ICEGATE login to operate under the new SCMTR. The categories of stakeholders who are required to be registered are as follows: a. Authorised Sea Carrier (Including Shipping line) (ASC) b. Authorised Sea Agent (Steamer/ Shipping Agent) (ASA) c. Authorised Carrier (other notified carriers) (ANC) d. Authorised Carriers for Inland Movement Transhippers (ATP) The applicant can edit or modify the details in already submitted application, if the same has not been approved by the officer concerned. In case officer has already approved the submitted application for registration, the applicant can submit amendment for the already approved details. Delivery of an Arrival Manifest in relation to a Vessel: 6. Regulation 4 of the SCMTR provides for the delivery of an arrival manifest in relation to the vessel by Authorised Sea Carrier. This document now replaces the `Import General Manifest` and is a legal requirement under Section 30 of the Customs Act, 1962, the details of which are outlined under Regulation 4(2) of the SCMTR. It is clarified that only the persons representing master of the vessel (i.e Vessel Operator) viz. the Authorised Sea Carriers (ASC)/ Authorised Sea Agents (ASA) are required to file the arrival manifest. The General declaration and Cargo declaration are made available together in ICEGATE as Sea Arrival Manifests (SAM) and other declarations in arrival manifest is made in ICEGATE as Sea Entry inwards (SEI). The timeline for the mandatory parallel filing of arrival manifest for different types of Vessel/Cargo is given in annexure A. 6.1. It is to be noted that the General declaration and the Cargo declaration associated with the arrival manifest, are mandatorily required to be delivered before the vessel departs from the last port of call before arrival of vessel at the Indian port. However, for non-containerized cargo the arrival manifest can be filed at any point in time, but before arrival of vessel at the Indian port. In case of SAM, amendments will not require any approval by the Customs officer if filed within following timelines: i. Short Haul Voyage (expected arrival less than 48 hrs) 6 hrs before expected arrival, ii. Medium Haul Voyage (expected arrival 48 96 hrs) 24 hrs before expected arrival and iii. Long Haul Voyage (expected arrival after 96 Hrs) 48 hrs before expected arrival. However, if the amendments are filed beyond the above timelines, they will require approval by the proper officer. Such amendment approval would also be given online. For filing a SAM, the vessel operator will have to give the details of the Container Bond registered in the Customs Automated System. For the purpose of SCMTR, a new national container bond has been introduced in the Customs System with the category name CG. This bond, once registered at a port can be used for filing SAM at any port across India. 6.2. Apart from ASC/ASA above, other persons such as Freight forwarders, NVOCC, consolidator or by whatever name they are called, who are party to Transport Document (viz. Bill of Lading) and issue delivery order may also file their part of cargo declaration directly with Customs as Cargo Summary Notification (CSN), instead of giving it to the vessel operator. The CSN is a declaration filed with Customs regarding the details of cargo covered under a Transport Document (viz. Bill of Lading). On successful submission of this declaration, a unique CSN number would be generated that will act as a reference number for the next declaration by the consolidator or the vessel operator (VOA). It is clarified that ASC/ASA can also prepare the arrival manifest by aggregating Cargo Summary Notification (CSN) filed separately by other Authorised Carrier. Further, a CSN can be filed not just by the other notified parties but also by the vessel operator. A vessel operator can file CSNs for every transport document if it has the necessary details and just refer the CIN numbers in the final arrival manifest. Similarly, in case of Arrival or Departure Manifests filed for subsequent movements, the CIN details may be referred, rather than filing the details afresh. The timeline for the mandatory parallel filing of cargo declaration for different types of goods is given in annexure A. Delivery of a Departure Manifest in Relation to a Vessel: 7. Similar to the procedural requirements as in para 6 on the import side, the same requirements are laid down on the export side under Regulation 5 of the SCMTR. For delivery of a Departure manifest, the concerned stake-holders, viz. the Authorised Sea Carriers (ASC)/ Authorised Sea Agents (ASA) would now be required to file Sea Departure Manifests (SDM) and Sea Departure Notification (SDN). SDM is the manifest required to be filed by Authorised Sea Carrier before departure of the vessel from any Indian sea port. The SDM, can be updated any time before SDN is filed without the approval of the officer. 7.1. SDN is the declaration having final reconciliation summary of the cargo actually carried by the vessel. SDN is filed by the Authorised Sea Carrier after the departure of the vessel within 24 hrs of the departure of the vessel for containerized cargo and 72 hrs for other cargo, which otherwise may attract late filing penalty. These documents would comprehensively subsume and replace the `Export General Manifests` and are expected to greatly reduce the various errors associated with exports on payment of IGST refunds. As in para 6.2, the other persons notified in this regard may file the Cargo Summary Notification (CSN). As in the case of arrival manifest, it is clarified that ASC/ASA can also prepare the departure manifest by aggregating Cargo Summary Notification (CSN) filed separately by other Authorised Carrier. The timeline for the mandatory parallel filing of departure manifest for different types of Vessel/Cargo is given in annexure A. Transhipment of Goods within India by Train/Truck: 8. Transhipment under the Regulation 7 of the SCMTR refers to any movement of Customs cargo between two Customs stations inside the country. The person responsible for the movement of the import/export goods within India is a Transhipper. There would be only one authorized Transhipper responsible throughout the movement of the transhipped cargo, irrespective of the modes of transport. The Transhipment Bond is also required to be executed by the authorized Transhipper. For filing declarations under the SCMTR, a transhipper should get registered in the category of Authorised Transhipper (ATP), who is also a stakeholder who requires registration as narrated in para 5 of this circular. Like a CG Bond, even for the purpose of transhipment under the SCMTR, a new national Transhipment Bond with category code `TG` has been made available in the Customs System to avoid the necessity of registering different bonds at different ports. The authorized transshipper is required to file arrival and departure manifests for every stage of the inland movement of the cargo. The manifests pertaining to the transhipment are made available in ICEGATE as `Customs Inland Manifest (CIM) Arrival (AR)/ Departure (DP)`. The manifests will have to be filed for every vehicle (truck/train) carrying the cargo upto and between inland Customs stations. The authorized carrier (i.e Transhipper) is required to file CIM DP/AR manifests before departure and upon arrival of the conveyance at the respective Customs stations. However, while a declaration will have to be filed before departure and upon arrival of the conveyance at the respective Customs stations, the declarant will be able to link the declarations made in the previous manifests for every cargo using the cargo identification number (CIN) assigned to the cargo. Thus, the process would be considerably eased to that extent. The ATP would also require to file the Allowed for Shipment Request (ASR) for every shipping bill when ready for departure at the port of export. Amendment of Arrival and Departure Manifests: 9. The declarant can submit amendment for the already submitted declarations, as provided for under Regulation 8 of the SCMTR. It may also be noted that both SAM and SDM can be amended after filing. Cargo Identification Number: 10. To uniquely identify the cargo and simplify the filing process, a system of CIN is introduced in Customs Automated system. CIN is a unique identification number assigned by Customs System to every cargo declared. In order to account for every consolidation and segregation of cargo seamlessly, two types of CIN would get generated: I. PCIN Primary Cargo Identification Number : It is the identification number assigned by Customs automated System to uniquely identify a cargo contained in single Transport Document (like Bill of Lading) mentioning Actual Buyer and Seller in imports. In exports, a PCIN would correspond to cargo covered under a single Shipping Bill. Having a PCIN for every cargo facilitates smooth filing of different declarations and removes duplicate filing effort, thereby simplifying the processes. II. MCIN- Master Cargo Identification Number : Since multiple cargoes can get consolidated under a consolidated Bill of Lading (BL), MCIN is the identification number assigned by Customs automated System for all the cargo covered under a consolidated BL. Each MCIN will be an aggregation of multiple PCINs. Referring to an MCIN in any subsequent manifest would mean reference to all the underlying PCINs. Mandatory Filing Requirements on Parallel Basis: 11. Optional test filing for all messages are available from October, 2020 and all the stakeholders are hereby requested to start filing the messages as per the guidelines issued by DG Systems. 12. The implementation plan and timelines for mandatory compliance pertaining to various stakeholders, and the documents to be filed by them are as per annexure A to this Circular. The different stakeholders would be required to adhere to the timelines as laid down in column 4 of the annexure A. Any stakeholder not adhering to the implementation plan as per the time-lines of filing schedule shall be liable to penalty as authorised under Regulation 13 of the SCMTR, 2018. 13. The detailed guidelines and FAQs for different categories of stakeholders are available on ICEGATE (https://www.icegate.gov.in/SeaManifestRegulation.html) and may be kindly referred to. 14. The Principal Chief/Chief Commissioners of Customs are requested to issue Public Notices and guide the trade suitably to ensure smooth implementation of the Sea Cargo Manifest and Transhipment Regulations. 15. Based on the queries received from various stakeholders and field formations, various clarifications are being provided herewith. 1. ANC (Authorized other Notified Sea Carriers): i. Registration for Customs Brokers also working as carriers: While there is no need for separate registration for Customs Brokers under SCMTR, many such entities are also engaged as freight warders, console agents etc. and therefore would require registration as ANC. The ANC registration has therefore been made available for entities having ICEGATE login as Customs Brokers. CBs, if also acting as other notified sea carriers as per the Regulations, may register under this category under the SCMTR. ii. Decrease in amount of Bank Guarantee along with surety bond: In terms of amended Board Notification No. 94/2020 (N.T.) dated 30.09.2020, the guarantee amount for Surety Bond required for ANC registration has been reduced to Rupees five lakhs from the earlier ten lakhs requirement in the System. Further, as stipulated in the aforesaid notification, the Authorized Economic Operator (AEO) and Customs Broker licensed under the Customs Brokers Licensing Regulations, 2018 are exempted from the requirement of bank guarantee. 2. ATP (Authorized Transhipper): i. Registration: It is noticed that although the registration under the category of Authorised Custodian (ACU) has been completed by many Custodians, the registration as Authorized Transhipper (ATP) registration is relatively less. The Custodians, who would also be doing Transshipment of Cargo, are required to be registered as ATP well. ATP registration requires officer approval. In this regard, the registration advisory as available on ICEGATE portal (https://www.icegate.gov.in/Download/Advisory_for_users_on_SCMTR.pdf) and ICES Advisory No. 04/2019 dated 28.02.2019 may be referred. ii. Requirement of National Transhipper Bond (TG Bond): Entities registered as ATP, who are responsible for the cargo during transshipment, are required to necessarily file/register a National Transhipper Bond (Bond Category - TG) in the System. The same was already mentioned in the previous SCMTR registration advisories and is also elaborated in the FAQs published on ICEGATE (https://www.icegate.gov.in/SeaManifestRegulation.html). However, it is noticed that the entities registered as ATPs are not registering TG bond in the system. As a result, the users filing CSN/SAM messages are facing difficulties because the Transhipper Bond is a mandatory input wherever Transshipment cargo is being manifested. The inland transshipment messages like CIM-DP/AR etc. will also required TG bond to be quoted. Zonewise list of entities already registered as ATP is also enclosed in Annexure I. It may kindly be ensured that TG bonds for each of these entities are registered in the System at the port of registration. Needless to mention, that TG bond registered at one port will be applicable across India. 3. ASC (Authorized Sea Carrier): i. Shipping Lines Registration as ASC : Before SCMTR, Indian offices of most of the foreign shipping lines used to get registered as shipping agents with Customs. As has been clarified several times before, under SCMTR, any direct representative of a foreign shipping line needs to take registration as ASC. It is learnt that many such entities have registered as ASA (Authorized Sea Agent) instead. While both the ASC as well as ASA can file sea manifests, details of the PAN of the actual carrier or the ASC are to be mandatorily given in the manifest. It may kindly be taken up with such shipping lines and necessary registration formalities as ASC for the authorized sea carriers be completed at the earliest. ii. Using foreign Shipping Line code as Commercial Code under Authorized Operation in SCMTR : a. During the registration as ASC, the entities are required to enlist the Shipping Line codes corresponding to the Shipping Lines they represent in the Authorized Operations section of the registration form. Earlier, shipping lines used to get their shipping line codes distinctly at customs locations. So, there were instances of same entity having different shipping line codes at different customs ports. However, to avoid any confusion in the declaration of Commercial Code for shipping lines under the Authorized Operations within Entity Registration in system, now the the unique foreign Shipping Line code as used internationally and enclosed in Annexure II can also be given by the ASC as commercial code. b. For ASCs contracted for chartered Bulk Cargo vessels operated by different Shipping Lines which may not be available at the time of registration, Commercial code can just be mentioned as BLK. Above clarifications may be widely circulated among the stakeholders and the registration process kindly be completed expeditiously. The manual offers a detailed account of all the features incorporated in the functionality and explains the steps involved in completing the SCMTR registration on ICEGATE 2.0. 2. Brief about User Manual Purpose The user manual is designed to provide step by step illustration of all the steps that are involved in the SCMTR Registration process. Intended Audience This user manual is intended for use by all the stakeholders who wish to apply for SCMTR Registration on the ICEGATE portal. The business/roles that are allowed required to obtain SCMTR registration are listed in Para 4 of this manual. 3. Overview This document aims to capture all the steps that are required to be followed while applying for SCMTR registration on ICEGATE. As per the new SCMTR Regulations, the persons mentioned in Para 4 of this manual shall have to be approved afresh by the proper officer for the purposes of the Regulations. In order to facilitate faster SCMTR registration, clicking on initiate authorization link on the dedicated SCMTR Enablement widget will show the registration form with maximum pre-filled information of the user for user s confirmation and any missing information will need to be provided by the user. The steps to be followed are mentioned below: Step-1. Log in to ICEGATE Dashboard User can access SCMTR widget by logging into their respective ICEGATE Dashboard by providing ICEGATE ID and Password and clicking on button. The User Type that needs to be selected shall be ICEGATE User . Step-2. Access SCMTR Enablement Widget User can find the widget on ICEGATE Dashboard. Clicking on Initiate Authorization link will open the form for SCMTR registration. Step-3. Fill SCMTR Registration Form On clicking Initiate Authorization link, the user will be redirected to the SCMTR registration form. The form is divided into three tabs. Each tab is explained in detail below : Step-3.1. Entity Details Guidelines For Filling the Entity Details Form: Entity Type: As per assigned role in the ICEGATE system, Entity Type will be auto assigned by the system. The table in Para 4 explains the Entity Type Code for each role on ICEGATE. Operations Type: User needs to select an option from the drop-down list. A GPS mobile app (e.g. Google maps) may be used for obtaining and furnishing the latitudinal and longitudinal. The longitudinal coordinate should begin with 0. Sample Longitude and Latitude Values are provided in the above screenshot of the form. Supporting Documents: The user will have to upload the necessary documents for verification. Maximum size allowed is 1.5 MB and the file type allowed has to be .PDF. The documents uploaded in SCMTR registration form must be digitally signed. In case the user does not have a digitally signed copy of the document to be uploaded, the user may use the document signing utility by clicking the sign button. Under Entity Details the following documents are to be uploaded: o Customs cases booked / Declaration of no Customs cases (Document code 022CO1) o MOU copy (Document Code 149SL1) (only applicable in case of Shipping line) Document Expiry Date: Expiry date of the uploaded document is to be provided and may be left blank is not available. Child User Details In this section, all the child users registered under in ICEGATE under the Organization are fetched from ICEGATE profile and shown here. The Parent user can select the child users that are to be mapped to SCMTR registration and provide details of the selected child users in this section. Select the user and click on button. User can also select multiple child users from Select All option. On clicking button, the system will display the form for filling the Child details. The following filed are captured in this form: Guidelines For Filling the Child User Details Form: Address: Auto-populated from ICEGATE Profile and Editable Identity Proof: Select one from the drop-down list of accepted proof of identity of the authorized person. The list of accepted Identity proofs is provided above in Step 4.2. Identity Proof ID: User needs to provide the Identification number mentioned on the copy of Identity Proof Uploaded Upload ID Proof Document: One of the eligible supporting documents to be uploaded. Maximum size allowed is 1.5 MB and the file type allowed has to be .PDF. The documents uploaded in SCMTR registration form must be digitally signed. In case the user does not have a digitally signed copy of the document to be uploaded, the user may use the document signing utility by clicking the sign button. Once all the details are provided, user needs to click button to proceed. Clicking on button will show the entire SCMTR form in a print preview viewing mode for review and confirmation. After the verification of all the details, if all the details are fine user to click button. Else, click button to go back and edit relevant fields. Clicking on button will send the details filled go to the jurisdictional Customs officer. The officer can approve or reject the application or raise a query for further clarification before approving / rejecting. The user can do necessary amendments, wherever required. 6. General Guidelines Kindly note the below guidelines related to SCMTR registration process: 1. Only a Parent user can access SCMTR registration form. 2. ASC is the Main Line Operator. The Indian offices of the foreign shipping line may operate as Authorized Sea Carriers. Any agent employed by the Authorized Sea Carrier to act on his behalf shall be registered as Authorized Sea Agent. 3. If a user is registered on ICEGATE under different roles, separate SCMTR registration application for each role will need to be submitted from the respective ICEGATE Dashboard. 4. If any information pre-populated from ICEGATE profile needs to be updated, the same needs to be updated at ICEGATE profile first and then to be re fetched in the SCMTR registration form. 5. Shipping Lines need not again register separately as ATP. Only Transshipment bond has to be given separately at the port of registration to operate as Transhipper also. Relevant field is available in the registration form. 6. For ACU operating at multiple locations, ICEGATE registration can be taken for the master entity at one of the locations. ACU is such person approved as Custodian by the Commissioner of Customs section 45 of the Customs Act 1962. 7. Error Codes In case the application submitted has any technical error, the system will generate an error along with an error code which will be communicated to the user.
