INSTRUCTION NO. 461/CBDT October 4, 1972 Section(s) Referred: 271(4A) of Income Tax Act Statute: Wealth Tax Act, 1957 The Board have considered the provisions of section 271(4A) of the I.T.Act and section 18(2A) of the W.T.Act. They desire that before disposing under any of these sections, the Commissioners should keeping in view the observations of the Supreme Court in the case of Dwaraka Nath vs.ITO(57 ITR 349) in connection with the revisional powers of the Commissioner u/s.264 of the I.T.Act, 1961 give an opportunity to the applicant to put forward his case either in writing or if he so desires by way of an oral hearing. 2. It is requested that action may be taken accordingly.
