INSTRUCTION NO. 934/CBDT Dated : March 9, 1976 Section(s) Referred: 53(3) ,53(4) Statute: Estate Duty Act The Board had occasion to consider the question whether in cases where no account has been delivered u/s 53 or 56 of the Estate Duty Act, 1953 to the Controller, the Controller should make assessment u/s 58(4) of the Act without issue of any notice or whether proceedings should be initiated u/s 59(a) of the Act. The Board are advised that in such cases the proper course for the Controller would be to act u/s 59(a) within the time-limit prescribed u/s 73A of the Act.
