Queries regarding withdrawals. - Income Tax - 1195/CBDTExtract INSTRUCTION NO. 1195/CBDT Dated : December 24, 1978 It has been brought to the notice of the Board that the Assistant Controllers of Estate Duty Call upon the accountable persons, as a matter of routine, to explain withdrawals in excess of Rs.1000/- made by the deceased during the period of two years prior to his death. It has been represented that this practice causes undue harassment to the accountable persons besides delaying assessments. 2. The matter has been considered by the Board. The Board desire that queries regarding withdrawals should not be raised in a routine manner but only if there is a prima facie need for the same. For the purpose, the Assistant Controller of Estate Duty may study the records and compare the extent of drawings in the two years prior to the date of death of the deceased with the withdrawals in the earlier year. The financial status of the deceased should also be given due weight. Suitable queries in this regard should be made only if there is something extraordinary or abnormal about the case.
