Amending various rules consequent to change in the power to issue exemption

In exercise of the powers conferred by section 37 of the Central Excises and Salt Act, 1944 (1 of 1944), the Central Government hereby makes the following rules further to amend the Central Excise Rules, 1944, namely :-

1. (1) These rules may be called the Central Excise (Third Amendment) Rules, 1989.

(2) Save as otherwise provided in these rules, they shall come into force on the date of their publication in the Official Gazette.

2. In the Central Excise Rules, 1944 (hereinafter referred to as the said rules), in rule 56-A,-

(a) in sub-rule (2), in clause (i) of the Explanation, after the words and figures "rule 8 of these rules", the words, brackets, figures and letter "or under sub-section (1) of section 5A of the Act" shall be inserted;

(b) in sub-rule (2B), after the words, brackets and figures "sub-rule (1) of rule 8", the words, brackets, figures and letter "or under sub-section (1) of section 5A of the Act" shall be inserted;

(c) in sub-rule (2C), for the words, brackets and figures "or the date of the notification issued under sub-rule (1) of rule 8, as the case may be,", the words, brackets, figures and letter "or, as the case may be, on the date of the notification issued under sub-rule (1) of rule 8 or under sub-section (1) of section 5A of the Act" shall be substituted.

3. In rule 56AA of the said rules, in sub-rule (2), for the words and figures "of the, Central Excise Rules, 1944", the words, brackets, figures and letter "or sub-section (1) of section 5A of the Act" shall be substituted.

4. In rule 57B of the said rules, after the words, brackets and figures "sub-rule (1) of rule 8", the words, brackets, figures and letter "or sub-section (1) of section 5A of the Act" shall be inserted.

5. In rule 71 of the said rules, with effect from 1st day of June, 1989,-

(a) in sub-rule (2), for the words "one of gross of boxes", the words "one hundred boxes" shall be substituted;

(b) in sub-rule (4), for the words "gross of boxes", the words "hundred boxes", shall be substituted.

6. In rule 73 of the said rules, with effect from the 1st day of June, 1989, for the words "ten gross", the words "ten hundreds" shall be substituted.

7. In rule 96K of the said rules, in sub-rule (2), after the words, brackets and figures "sub-rule (1) of rule 8", the words, brackets, figures and letter "or under sub-section (1) of section 5A of the Act" shall be inserted.

8. In rule 96ZY of the said rules, in sub-rule (2), after the words, brackets and figures "sub-rule (1) of rule 8", the words, brackets, figures and letter "or under sub-section (1) of section 5A of the Act" shall be inserted.

9. In rule 97 of the said rules, in the proviso, in clause (v), after the words and figure "under rule 8", the words, figure and letter "or section 5A of the Act" shall be inserted.

10. In rule 173L of the said rules, in sub-rule (3), in clause (i), after the words and figure "under rule 8", the words, figure and letter "or section 5A of the Act" shall be inserted.

11. In rule 192 of the said rules, after the words and figure "under rule 8", the words, figure and letter "or section 5A of the Act" shall be inserted.
