Dear sir,

We are maintain RG 1 for product of  own manufacturer.   received material after jobwork u/r4(5)  we take this entry in RG 1 Manufacture coloumn. & also mention in ER-1 Return , Is it correct. Please advice.

Dear Manoj,

Though I had replied to this query long ago but it seems that further clarification is required on this matter for better understanding:-

  1. Please identify that Whether your product is finished or semifinished or requires further processing in the form of Jobwork?
  2. Why there is a requirement of jobwork, if the product is final and entered in the DSA (RG-1)?
  3. Is your company is skipping any critical step of  the complete manufacturing process flow chart by sending the finished goods for jobwork?
  4. Whether this jobwork is required on the entire finished goods or required for part of finished goods or  it is required for customer's specific request?
  5. Whether jobwork charges are being included in the assessable value of the goods while removing it from your factory premises.

It seems, that when you get the goods back in your factory premises (after jobwork), it become finished goods at that particular moment.  Since, you are mentioning and reporting in the ER-1, it means you are not hiding anything from the Department.  

Please also discuss this issue with your Seniors and with your Counsel to dig out  the appropriate solution to this matter.
