Madam/Sir, Reference is invited to Department of Chemical and Petrochemical, Ministry of Chemical and Fertilizer's Ortho Phosphoric Acid (Quality Control) Order, 2021 dated 15.06.2021, amendment notification S.O. No. 4914 (E ) dated 29.11.2021, S.O. No. 2225 (E) dated 13.05.2022 and S.O. No. 1709 (E ) dated 13.04.2024. (copies enclosed) . 2. Now, vide amendment notification S. No. 1709 (E) dated 13.04.2024, following proviso has been inserted in Ortho Phosphoric Acid (Quality Control) Qrder, 2021: Ortho Phosphoric Acid when used as raw material in production of fertilizers, has been exempted from BIS Standard IS 798: 2020 for a period of ninety days from the date of publication of this notification . 3. In this regard, it is requested that necessary action may be taken to sensitize officers under your jurisdiction regarding the above matter. 4. In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) (hereinafter referred to as the said Act), the Central Government being of the opinion that it is necessary or expedient so to do in the public interest after consultation with the Bureau of Indian Standards, hereby makes the following order, namely:- 1. Short title, commencement and application. (1) This order may be called the Ortho Phosphoric Acid (Quality Control) Order, 2021. (2) It shall come into force on the One hundred and eighty- first day from the date of its publication in the Official Gazette. (3) It shall apply to goods or articles specified in column (1) of the Table below, but shall not apply to such goods or articles meant for export. 2. Conformity to standard and compulsory use of Standard Mark.- Goods or articles specified in column (1) of the Table below shall conform to the corresponding Indian Standard specified in column (2) of the said Table and shall bear the Standard Mark under a licence from the Bureau of Indian Standards as per Scheme-II of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. 3. Certification and enforcement authority.- The Bureau of Indian Standards shall be the certifying and enforcing authority in respect of the goods or articles specified in column (1) of the Table. 4. Penalty for contravention. - Any person who contravenes the provisions of this order shall be punishable under the provisions of the said Act. In exercise of the powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government, after consulting the Bureau of Indian Standards, is of the opinion that it is necessary or expedient so to do in the public interest, hereby makes the following Order further to amend the Ortho Phosphoric Acid (Quality Control) Order, 2021, namely:- 1. Short title and commencement. ─ (1) This Order may be called the Ortho Phosphoric Acid (Quality Control) Amendment Order, 2024. (2) It shall come into force on the date of its publication in the Official Gazette. 2. In the Ortho Phosphoric Acid (Quality Control) Order, 2021, after the table, the following proviso shall be inserted, namely: - Provided that, nothing in this Order shall apply to the Ortho Phosphoric Acid when used as raw material in production of fertilizers for a period of ninety days from the date of publication of this notification .
