2003 (5) TMI 363 - HC - Companies Law

The High Court of Rajasthan dismissed a company petition filed under sections 433, 434, and 439 of the Companies Act, 1956. The petition sought recovery of a due amount for purchased cotton bales, but the court found it to be a pressure tactic without valid reason. The court stated that winding-up proceedings are not appropriate for bill payments and suggested filing a summary suit instead. The petition was dismissed as it was seen as an attempt to circumvent the civil suit remedy.
