Issues:
Late filing of Import Manifest leading to imposition of penalties.

Analysis:
The case involved two appeals filed against the Order-in-Appeal passed by the Commissioner of Customs (Appeals), Bangalore, regarding the imposition of penalties for delays in filing Import Manifests. The appellants, registered as Consol Agents under the Customs Act, were penalized for late filing of Import Manifests during August and September. The Original Authority imposed penalties totaling Rs. 1,01,000/- and Rs. 1,35,000/- for different instances of delay. The first Appellate authority upheld these penalties, leading to the appeals. The appellants argued that delays were not solely their fault, citing system failures and contending that penalties should not be mandatory under Section 30 of the Customs Act. The Tribunal directed the Original Authority to pass a speaking order after giving the appellants an opportunity to present their case. Consequently, the stay applications and the appeals were allowed, remanding the case to the Original Authority for further examination and a revised decision.
