However, the court found MICO's case to be correctly decided, emphasizing that the principles of valuation for excise duty do not apply to entry tax under the KTEG Act. The court reiterated that the value of goods for entry tax is the purchase price at the time of entry into the local area, not influenced by subsequent MODVAT credits.

The petitioner cited Supreme Court decisions in H.M.M. Limited, Eicher Motors Ltd., and Dai Ichi Karkaria Ltd., arguing these should influence the valuation for entry tax.
