The appeal challenged the High Court's dismissal of a Civil Revision filed by Bhanu Kumar Jain against the election of Shri Kailash Vijayvargiya as Mayor of Municipal Corporation of Indore. The main contention was Vijayvargiya's disqualification as a sitting member of the Legislative Assembly under the M.P. Municipal Corporation Act, 1956. The election petition was initially dismissed by the District Judge and subsequently by the High Court, leading to the present appeal.

It was noted that the term of Mayor Vijayvargiya had already ended, rendering the appeal moot. The appellant sought expedited resolution of election petitions and revisions, but the lack of complete material prevented the court from issuing any specific directions regarding the delays in disposal of such matters.

Municipal Corporation Act, 1956 to prevent individuals from simultaneously holding positions as a member of the Legislative Assembly and Mayor of a Municipal Corporation. The court held that such policy decisions fall within the purview of elected representatives and cannot be mandated by the judiciary. Citing legal precedents, the court emphasized that courts cannot direct legislatures to enact specific laws or amendments.
