The Delhi High Court set aside an award dated 8th June, 1994 under Sections 16(c), 20, and 33 of the Arbitration Act, 1940. The court found that the Arbitrator was wrong to reject the claim based on a clause requiring arbitration demand within 90 days. This clause was deemed invalid under Section 28 of the Contract Act. The court directed a reconsideration of the claims on their merits by a new Arbitrator if needed.
