It was noted that service tax liability would apply only to software developed as per customer specifications and supplied to clients. The Tribunal directed a re-examination of the matter, emphasizing the need to review agreements with clients, invoices, and payment records to determine the correct service tax liability. The appellant was instructed to cooperate with the department, provide all necessary documents, and appear before the adjudicating authority by a specified date. Decision: The Tribunal allowed the appeal by remanding the matter for fresh consideration. The stay application was also disposed of. The appellant was directed to submit all relevant documentary evidence to support their claim of correctly discharging the service tax liability.
