The Allahabad High Court passed a decree in favor of the plaintiffs in a suit for ejectment from a plot of land and buildings. The defendant claimed to be a transferee from the heirs of a tenant, but the courts disbelieved evidence of a permanent lease condition. The courts held that the lease was from month to month, not permanent, based on evidence presented. The appeal was dismissed with costs, and leave to appeal under the Letters Patent was refused.
