Issues:
Challenging order setting aside deemed extension of mining lease. Analysis: The High Court of Karnataka heard a writ petition challenging the order passed by the National Company Law Tribunal, Chennai, regarding the extension of a mining lease. The State had rejected the deemed extension of the mining lease and was directed to execute Supplemental Deeds extending the lease period. The State, represented by Sri A.S.Ponnanna, raised several contentions during the hearing. However, the Senior Advocate for the respondent suggested setting aside the impugned order and sending the matter back to the Tribunal for further proceedings. In light of this submission, the Court decided not to delve into the merits of the case. The Court, in its final order, set aside the order passed by the National Company Law Tribunal and restored the application filed by the first respondent to the Tribunal's file. Both parties were directed to appear before the NCLT in Chennai without awaiting further notice on a specified date. The State Government was granted liberty to respond to the notice issued by the NCLT. The writ petition was disposed of with the above observations, keeping all contentions of both parties open. No costs were awarded in this matter.
