2020 (6) TMI 749 - Tri - Companies LawCompliance with the direction to effect paper publication in vernacular in Malai Chudar vide Order dated 08.06.2020 - HELD THAT - For publication of advertisement when approached the office of Malai Chudar seems to be closed and hence the Petitioner is not in a position to comply with the Order dated 08.06.2020. In the circumstances, the applicants seeks for an alternative in relation to effect the publication before the date of hearing on 09.07.2020 in vernacular i.e., Dinamani Tamil Nadu edition instead of Malai Chudar . The Application stands allowed and the Petitioner Companies are directed to effect paper publication in vernacular Dinamani Tamil Nadu edition as sought for in the Application instead of Malai Chudar' as originally ordered - Application allowed.

Analysis: The Tribunal received applications related to CP/219 & 220/CAA/2019, which were admitted, and the Petitioner Company was directed to publish in the newspaper "Malai Chudar" as per the initial order dated 08.06.2020. However, due to the closure of the "Malai Chudar" office, compliance with the original order was not possible. The Applicant Companies requested an alternative to publish in "Dinamani" Tamil Nadu edition before the hearing scheduled on 09.07.2020. The counsel for the Applicant Companies assured that they could meet the publication deadline ten days prior to the hearing date. Considering the representation made by the counsel, the Tribunal allowed the application, granting permission to the Petitioner Companies to publish in the vernacular newspaper "Dinamani" Tamil Nadu edition instead of "Malai Chudar" as initially ordered. The direction was given to ensure compliance with the publication requirement before the hearing date. Therefore, the applications were allowed with the revised publication instructions in "Dinamani" newspaper.
