2018 (5) TMI 2117 - HC - CustomsProvisional release of goods - whether DRI can impose new conditions for provisional release of goods, without following the directions given? - HELD THAT - The learned Adjudicating Authority is not bound to follow the conditions issued by the DRI in Para 5 of the letter dated 23/11/2017 by passing order for provisional release of goods. The aforesaid order is appealable. Instead of entertaining this writ petition, the petitioner is permitted to file a statutory appeal before the learned Appellate Authority, in accordance with law - petition disposed off.
The High Court of Madhya Pradesh allowed the petitioner to file a statutory appeal before the Appellate Authority regarding the provisional release of goods, stating that the Adjudicating Authority is not bound by the conditions imposed by the DRI. The writ petition was disposed of accordingly.
