2021 (10) TMI 1441 - SC - Indian LawsFraming charges Under Sections 27A and 29A of the Narcotic Drugs And Psychotropic Substances Act, 1985 - recovery of narcotic drugs or psychotropic substances from the premises of the two Appellants - Section 67 of the N.D.P.S. Act - HELD THAT - While not interfering with the order directing framing of charges Under Section 9A and 25, direction in the impugned order to frame charges against the two Appellants namely, Sanjeev Chandra Agarwal and Rajiv Sethi Under Sections 27A and 29A of the N.D.P.S. Act cannot be sustained and is set aside. Appeal allowed.
The Supreme Court set aside the High Court's order directing framing charges under Sections 27A and 29A of the N.D.P.S. Act against the Appellants due to lack of recovery of narcotic drugs. Charges under Sections 9A and 25 were upheld. Bail for the Appellants remains unaffected.
