2024 (7) TMI 1539 - HC - Indian LawsSeeking grant of regular bail - possession of 305 gms of Heroin, which is commercial quantity - applicant submits that in order to allay the apprehension of the applicant being a flight risk, the applicant volunteers to surrender his passport to the concerned I.O. - Sections 21 NDPS Act, Section 14 Foreigner Act and Sections 471/474 IPC - HELD THAT - Considering the period of custody as well as the fact that till date only 6 witnesses have been examined and that the trial is likely to take some time, this Court is of the opinion that parameters of Section 37 stand satisfied. It is directed that the applicant be released on regular bail subject to his furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/ concerned Court/Duty M.M., subject to depositing the passport with the concerned I.O. and subject to fulfilment of conditions imposed - bail application allowed.
