Considering the precedents of Gujarat Ambuja Cement Ltd. and NRC Ltd., the Tribunal concluded that the applicant was entitled to Modvat credit, waiving the pre-deposit of duty and penalty. The matter was scheduled for regular hearing on a specified date.
