The Appellate Tribunal CEGAT, Kolkata allowed the appeals and modified the order by dispensing with the predeposit of penalty amounts for two individuals involved in a case concerning confiscated ball bearings. The Tribunal found that there was no evidence to show that the driver was aware the goods were smuggled, and the penalty based on uncorroborated statements was not warranted for the other individual.
