Clause 215 - Refunds. - Direct Taxes Code, 2010Extract H.—Refunds 215. (1) An assessee shall be entitled to a refund of the excess of any amount paid by him or on his behalf, or treated as paid by him or on his behalf, for any financial year over the amount with which he is liable under this Code. (2) Every claim for refund shall be made within such time and such form and manner, as may be prescribed. (3) An assessee shall, in a case where an assessment is set aside or cancelled or an order of fresh assessment is directed to be made in an appeal, or any other proceeding under this Code, be entitled to the refund only on the making of the fresh assessment. (4) The amount of refund determined under this sub-chapter shall be reduced by the amount, if any, remaining payable under this Code by the assessee to whom the refund is due, and the balance amount of refund, if any, shall be issued along with an intimation to this effect to the assessee. (5) In a claim under this Sub-chapter, it shall not be open to the assessee to question the correctness of any assessment or other matter which has become final and conclusive or ask for a review of the same, and accordingly the assessee shall not be entitled to any relief on such claim except refund of tax paid in excess.
