Section 1 - Short title and commencement - Companies (Amendment) Ordinance, 2019

MINISTRY OF LAW AND JUSTICE (Legislative Department) New Delhi, the 12th January, 2019/Pausha 22, 1940 (Saka) THE COMPANIES (AMENDMENT) ORDINANCE, 2019 No. 3 OF 2019 Promulgated by the President in the Sixty-ninth Year of the Republic of India. An Ordinance further to amend the Companies Act, 2013. WHEREAS the Companies (Amendment) Ordinance, 2018 was promulgated by the President on the 2nd day of November, 2018; AND WHEREAS the Companies (Amendment) Bill, 2019 to replace the Companies (Amendment) Ordinance, 2018 has been passed by the House of People on the day of January, 2019 and is pending in the Council of States; AND WHEREAS the Companies (Amendment) Bill, 2019 could not be taken up for consideration and passing in the Council of States; AND WHEREAS the Companies (Amendment) Ordinance, 2018 will cease to operate on the 21 st day of January, 2019; AND WHEREAS it is considered necessary to give continued effect to the provisions of the Companies (Amendment) Ordinance, 2018; AND WHEREAS Parliament is not in session and the President is satisfied that circumstances exist which render it necessary for him to take immediate action; NOW, THEREFORE, in exercise of the powers conferred by clause (1) of article 123 of the Constitution, the President is pleased to promulgate the following Ordinance:- Short title and commencement 1 . (1) This Ordinance may be called the Companies (Amendment) Ordinance, 2019. (2) It shall be deemed to have come into force on the 2 nd day of November, 2018.
