2019 (3) TMI 1288 - HC - Customs

Issues: Correction of errors in a judgment

The judgment delivered by the Gujarat High Court involved correcting errors in a previous judgment dated 04.02.2019. The petitioner's advocate pointed out mistakes in paragraph 50 of the judgment, specifically regarding the wording related to Notification No.18/2015-Cus. The court acknowledged the errors and made the necessary corrections as requested by the advocate. The corrected version of paragraph 50 was provided in the judgment, which essentially struck down certain conditions as ultra vires and allowed the petitions, ruling in favor of the petitioners. The court made the corrections as per the submission by the advocate, ensuring the accuracy of the judgment.

The main issue in this judgment was the correction of errors identified in a previous judgment passed by the Gujarat High Court. The petitioner's advocate highlighted the inaccuracies in paragraph 50 of the judgment, specifically related to the wording concerning Notification No.18/2015-Cus. The court, after perusing the submission, agreed with the advocate's assessment of the errors. Consequently, the court proceeded to rectify the mistakes by deleting certain words, inserting the correct term, and adding a missing comma in paragraph 50. The corrected version of paragraph 50 was provided in the judgment, which ultimately led to the striking down of certain conditions and the allowance of the petitions in favor of the petitioners. The court's decision to correct the errors as pointed out by the advocate ensured the accuracy and validity of the judgment.
