Instructions -requiring drawl of samples and sending the same for testing as per requirement of the assessing group or as per requirement of any Allied Act, - Customs - 01/2015Extract C. Nu.VIII (12) Import/Tech/348/2015/11086 Dated: 27/03/2015 Standing Order No: 01/2015 In Order to have uniform practice for drawl and forwarding of samples for testing and receipt of test reports, the following guidelines may be followed. However, it is also emphasized that the instructions contained in the Appraising Manual regarding the manner of drawl of samples, their sealing etc. and CBEC's instructions and other instructions specific to an issue which requires drawl of samples should also be strictly adhered to. 2. In all cases requiring drawl of samples and sending the same for testing as per requirement of the assessing group or as per requirement of any Allied Act, after registration of Bill of Entry in the Import Shed, the Inspector/ Examining officer should physically draw the representative samples in triplicate in the presence of CHA/Authorized representative of the importers. The representative samples should then be packed in an envelope/paper/jar/container etc. bearing all the relevant details viz Bill of Entry No. Data, name of importer, Name of Customs Broker/CHA, item description, batch/lot No., date of manufacturing, date of expiry, etc. and the signatures of the Inspector/ Examining Officer as well as the Importer/ Importer s authorized representative should be obtained on the cover/package in which the sample(s) is packed. Thereafter, the representative sample(s) should be sealed with Customs Seal in the presence of the Importer/ Authorized representative of the Importer. Product literature/ catalogue/ technical literature/ etc. if any found in the consignment should also be attached along with the sample(s) and the test memo. The test memo, in triplicate, will be sent by the AC/DC Shed to the concerned group AC/DC and each test memo will be filled by the Assessing Officer i.e. Appraiser / Superintendent in the Group. The test memos will be returned to the Shed and AC/DC Shed will than forward the sealed sample alongwith the test memo to the concerned lab for testing. One copy of the test memo will be retained by the Group, One copy by the Shed and one copy will accompany the sealed sample. Details of test memo will be entered in the register maintained in the shed mentioning clearly date of dispatches of the sample to the testing lab. On receipt of the test report the details of the same will be duly entered in the concerned register maintained by the Shed. The AC/DC Shed will forward the original test report to the concerned Group within 24 hours of receipt and will also keep a photocopy of the same for record the concerned Group will acknowledge receipt of the test report in the register maintained by the Shed. 3. As the Assistant Drugs Controller(ADC) and Officers from Wild life Authority(WLA) are available in the Import Shed, the Inspector/ Examining Officer should not draw the sample(s) and these Bills of entry should be marked to the ADC/WLA Officers after feeding all the details in the sample register maintained with Superintendent/ Inspector (Administration) in the import shed. Time Date of forwarding the respective Bills of Entry to the ADC/WLA Officers should be noted in the register maintained for this purpose. The ADC/WLA Officers should draw the sample(s) as per the laid down procedure and give the test report in the prescribed manner and within the stipulated period. 4. Further, where Sample needs to be tested by CRCL, the Department has developed an online EDI CRCL Module namely, the Central Revenue Control Laboratory (CRCL) Module, which has been developed and implemented in the ICES w.e.f. 20th January, 2015. All samples to be sent to CRCL has to be only through this EDI module. 5. The seals used for sealing of samples should be kept in safe custody of the designated officer. Further, all sample(s) should be stored only in the location/ area earmarked for the purpose and their safe custody should be ensured by the officer/ sepoy concerned. The AC/DC (Admn) will issue an order designating the officer in- charge of sampling and safe custody of the sample(s). 6. The Superintendent (Admn.), Import Shed should review the sample register every fortnight and take up those cases with the concerned laboratories/ agencies from where test reports are found to be pending for more than a week. 7. Difficulties, if any, in implementation of these instructions may kindly be brought to the notice of the undersigned. (S.R.
