Non filing of Import and Export Documents in EDI (ICES) - Customs - 03/2015-16

BALAJI TEMPLE KANDLA, KUTCH, GUJARAT F.No.S/12-11/ED1/2011-12 FACILITY NOTICE : 03/2015-16 Date : 21-01-2016 Subject: Non filing of Import and Export Documents in EDI (ICES) Attention of all the Trade Associations including Importers/Exporters/Customs Brokers is invited to the Office Note No.02/2013-14 dated 20.11.2013 issued by the Commissioner of Customs, Custom House, Kandla. In the case of import of Steam Coal of Indonesian Origin, EDI (ICES) system was not accepting two BCD notifications simultaneously and as manual filing of Bill of Entry was the only option, the Asstt./Deputy Commissioner of Customs was authorized for the permission for filing of manual Bills of Entry. Now, it has been conveyed by the Deputy Director, D. G. System, Delhi that the inability of ICES system that CVD column was accepting only Excise Notification by default and was not recognizing the Customs Notification has been overcome by adding another column CVD Flag in ICES. For Indonesian Coal related Bills of Entry, to claim CVD under Customs Notification No.012/2012 sl.no.123, the CVD Flag should be changed to C to indicate customs notification. Similarly, to avail CVD exemption under excise Notification by overriding CVD part of Customs notification (for eg. In Muriate of Potash), the officer may make CVD flag as E and enter the CE Notification. Since, this involves changes in Bill of Entry format (which is being contemplated very soon), it is not available during filing. However, Appraiser of Customs has been given an option under ICES to provide this exemption using above stated option. Accordingly, now onwards Bills of Entry for the import of Indonesian Coal may be filed under ICES and may be cleared as per the above guidelines. The Office Note No.02/2013-14 issued on 20.11.2013 stands modified to the above extent.
