F.No. S/3-PSO(GEN) 19/15-16 M-III Date:- 28/01/2016 PUBLIC NOTICE NO. 29/2016-ACC-M-III APPROVAL UNDER NOTIFICATION NO.01/2016-CUS-ACC M-III l. In exercise of the powers conferred under Section 45 (l) and 141 (2) of the Customs Act,1962 and Regulation 10 of Handling of Cargo in Customs Area Regulation,2009 (HCCAR,2009) notified vide Notification No.26/2009-Customs NT dated 17.03.2009 by the Department of Revenue, Ministry of Finance, Government of India, I, J.P.Singh, Commissioner of Customs (General), Zone-III, Mumbai, do hereby appoint M/s. Bharat Diamond Bourse (BDB), as Custodian (Custom Cargo Service Provider) for import and export cargo of diamonds, precious and semi-precious stones, pearls jewellery made of gold or any other precious metal, with or without studding industrial diamonds including powders both natural and synthetic, credit cards, currency notes, traveler cheque, precious metal and synthetic stones and such other similar items as may be specified from time to time until they are transshipped at PCCCC,BKC or till exportation by the Airlines to their overseas destination as per the provisions laid down under the Customs Act, 1962 HCCAR,2009 and Rules Regulations made thereunder subject to the following conditions:- (iv) The Custodian (Custom Cargo Service Provider) shall comply with all the provisions of the Customs Act, 1962, especially those in Chapter VI and VII of the said Act and Rules and Regulations notified in this regard such as Handling of Cargo in Customs Areas Regulations,2009 issued vide Notification No.26/2009-Customs (N.T.) dated 17th March,2009, by Government of India, Ministry of Finance, Department of Revenue, New Delhi, as amended from time to time as are applicable to custodian of goods in Customs Area. (v) The Custodian (Custom Cargo Service Provider) shall pay to the Government or the proper officer, on demand, any amount of Customs Duty payable on the imported goods pilfered or not accounted for, as per Section 45(3) of the Customs Act, 1962. (vi) The goods shall be stored in areas as detailed below:- CARGO HANDLED/STORAGE AREA EXTENT OF AREA AND TYPE OF CARGO HANDLED M/s.Bharat Diamond Bourse Strong Room at ACC,Sahar, Mumbai. Area admeasuring 50.62 Sq.Mtrs at Export Shed near MIA I . Export Examination Area-II in front oi Gate No.4 B at Air Cargo Complex, Sahar, Mumbai-99 for storage/ import/ export cargo of diamonds, precious and semi-precious stones, pearls jewelries made of gold or any other precious metal, with or without studding industrial diamonds including powders both natural and synthetic, credit cards, currency notes, traveler cheque, precious metal and synthetic stones and such other similar items as may be specified from time to time until they are transshipped at PCCCC,BKC or till exportation by the Airlines to their overseas destination 3. The duration of the appointment shall remain valid for a period of 02 years i.e. 20.01.2018. (JAI PRAKASH SINGH) COMMISSIONER OF CUSTOMS (GENERAL) AIR CARGO COMPLEX, ZONE-III, MUMBAI.
