No.: S.Misc.309/2017-DBK (Air) Dated: 06.12.2018 PUBLIC NOTICE NO. 37/2018 Sub: Budget 2018-19 - Filing of Bills of Entry and Shipping Bills in ICES - reg. *********** Attention of Exporters/ Customs Broker/ Airlines/ members of the ma-M trade and all stake holders, particularly FEEO and various export promotion councils are invited to the Drawback pendency report published by the department in the official website under Public Information. The error details pertaining to Drawback claims for Air Cargo, Chennai Commissionerate (Chennai-VII) as on 31st December,2013 are as under:. No. of shipping bills pending due to ECM's not filed No. of shipping bills pending due to ECM's filed with errors 4805 2750 2. It can be seen that an alarming number of shipping bills filed upto December 2013 are still pending for clearance because of EOM's filed. with errors and ECM's not filed due to which these shipping bills can-not be processed for drawback. These details are available in the public domain and are also shared with Airline operators/ FIEO routinely. However, the stake holders have not made any efforts to recti.fr and regularize the same which has resulted in piling up of non-processable drawback claims. The Members of the trade, Airlines/ Exporters/ Customs Brokers/ Airlines/ members of the ENM bade 1d all stake holders, particularly FIEO and various export promotion councils are once again called upon to identify and rectify the errors so that the Shipping Bills would move to the Drawback queue for sanctioning of duty drawback by the Custom Officers to the exporters. 3. In respect of 4805 Shipping bills (list attached), the Airlines are yet to file EGMs. This office has time and again discussed, in various meetings with the stake holders, the need for immediate submission of EOMs so as to serve the exporters in early realization of duty drawback on the goods exported by them. Unfortunately, the response in general from the stake holders is far from encouraging. 4. There are 2750 Shipping Bills filed till December 2013 which. are pending at EGM error queue (list attached). The list is also published the official website of this Cornmissionerate, www.aircustomschennai.gov.in and the Airlines/ Exporters/ Customs Brokers are given opportunity to the DGM errors in respect of these Shipping Bills by 30.12.2018. 5. This notice may be treated as intimation of deficiency in the drawback claim issued in terms of Clause 3 (a) of Rule 13 of Customs, Central Excise Duties and Service Tax Drawback Rules, 1995, as amended in respect of all the listed Shipping Bills. If no reply/ response is received on or before 30.12.20182 these drawback claims shall be rejected and processed as zero drawback without giving any further notice to the exporter. 6.
