No. V(30)01/Tech/Misc/Agar/2015 Dated: 09.02.2015 Trade Notice No.- 02/2015 Subject: Export without Payment of Duty (Except to Nepal Bhutan) by Merchant Exporters; Execution and Acceptance of Bond- Reg. In exercise of the powers conferred upon me vide Para-3 of CBEC Circular No. 500/66/99-CX dated 15/12/99 issued from F. No. 209/26/99-CX-6, I hereby designate Assistant/Deputy Commissioner (Tech.), Central Excise Commissionerate, Agra as Assistant/Deputy Commissioner of Central Excise (Export) {for entire jurisdiction of Central Excise Commissionerate, Agra} for the purpose of facilitating export under bond in terms of Circular NO. 500/66/99-CX dated 15/12199 under Rule 19 of Central Excise Rules 2002 read with Notification No. 42/2001-CE (NT) dated 26/06/2001. The function of the Assistant/Deputy Commissioner of Central Excise (Export) shall be similar to the Maritime Commissioner. Any Merchant Export/ Manufacturer-cum-Merchant Exporter can file the required bond with the Assistant/Deputy Commissioner of Central Excise (Export) under whose jurisdiction his Head Office/Factory is located (within the jurisdiction of the Commissionerate). In such case the exporter can procure the goods from a factory located anywhere in India. For clarification. it is mentioned that the Assistant/Deputy Commissioner of Central Excise (Export) will not deal with the exports where the manufacturer-exporters are permitted to export by furnishing an Annual Undertaking (UT-I) in lieu of Bond. While discharging its functions, the Assistant/Deputy Commissioner of Central Excise (Export) will ensure proper verification of the credentials of the parties and strict compliance of the instructions issued by Ministry/Board in this regard from time to time.
