No. S/43-CONT(B)43/2015 CC Date: 10-10-2016 PUBLIC NOTICE No. 122/2016 Sub: Import of container of durable nature Attention of the Steamer Agents/importers IS invited to the Government of India, Ministry of Finance, Notification No. dated 16-03-1994, Public Notice No. 59/94 dated 03.06.1994 and Public Notice No. 5/2016 dated 13-01-2016, both issued by this Custom House. 2. As per the above Notification, container of durable nature are permitted to be imported into India temporarily without payment of Customs Duty, on execution of Bond l) the steamer agents or shipping line or importers, provided that these containers are re-exported within a period of six months from their date of importation. Each bond shall specify the number and type of containers likely to be handled by the Steamer Agent/importers/shipping line during the period. 3. The Board's Circular No. 31 / 2005 dated 25-07-2005 states that the nature of Bond prescribed to be as 'Continuity Bond' covering the Duty element of the imported containers, valid for a year and extendable till further such period as requested by the person executing the Bond. 4. In view of the Board's above referred Circular, all the concerned are informed that the yearly Bonds submitted for the Calendar Year 2016 with the Container Cell, New Custom House, Mumbai-400001 with the purpose of import of duty free containers, can be kept alive on the basis of a written request before the expiry of this Bond, provided that no material changes such as change in management or authorized signatories or Power of Attorneys or any other adverse strictures passed by any statutory bodies or any Court of Law had effected during the currency of the Bond. If no written request is received from the concerned, within the prescribed period, will be presumed that the importers are not Interested in 'continuing' the present Bond and therefore they have to file a fresh Bond for the coming year/ s as the Bond submitted for 2016 will be no more suffice for the purpose. 5. It is also clarified that in future, all yearly Bonds can be renewed In terms as per Para No. 4 above. However, this facility is not with retrospective effect i.e. for the yearly bonds submitted for the Calendar year 2015 or earlier, which are yet to be cancelled/ closed on account of non-export of such duty-free imported containers. 6. It is further clarified that whenever the containers are imported Duty-free, the numbers of such containers has to be debited from the number of containers mentioned in the Bond and whenever such containers are re-exported the same number of containers be credited back in the Bond. In any circumstances, at any given time, the total number of containers shall not exceed the permissible limit of such Bond executed. [n case the importer desires to import such duty- free containers which may exceed the permissible limit under the Bond, they have to give additional Bond (or may be higher) to that extent. The importer may cancel such additional bond or they may keep them alive along with the original Bond till they desires to do so. 7.
