VR Persulfates Pvt. Ltd. Vs. Union of Indio Ors- Clearance of Goods - M/reg - Attention of all Importers, Exporters, Custom Brokers, Members of Trade Industry Associations, Custom officers and all concerned are invited to Hon'ble High Court of Guarat s Order dated 24.04.2019 in Special Civil Application (SCA) No. 7760 of 2019 filed by M/S. VR. Persulfates Pvt. Ltd. Vs. Union of India Ors - Clearance of Goods in this regard. 2. Anti-Dumping duty on imports of Persulphates originating in or exported from China PR and Japan was imposed vide Notification No. 96/2007-Cus dated 29.07.2007 for a period of five years. These duties were extended vide Notification No. 11/2013-CUS(ADD) dated 16.05.2013 for a further period of 5 years till 15.05.2018 following a sunset review initiated by Director General of Trade Remedies(DGTR). Further anti-Dumping duty on imports of persulphates originating in or exported from Taiwan, Turkey and USA was also imposed vide Notification No. 22/2014- CUS(ADD) dated 16.05.2014 for a period of five years till 15.05.2019. 3. Subsequently, petitioner M/S. VR Persulfates Pvt. Ltd. had filed a combined petition for the both above cases i.e. Persulphates origination in or exported from China PR, Japan, Taiwan. Turkey and USA. Accordingly, the DGTR has initiated the investigation., After conducting the investigations, the DGTR issued final findings vide notification F.No. 7/5/2018-DGAD dated 14.12.2018 holding that there was no justification for further continuation of anti dumping duty on persulfates. 4. The petitioner Ws. VR Persulfates Pvt. Ltd., being aggrieved and dissatisfied with the final findings of the DGTR, had filed a special Civil Application No. 7760 of 2019 before the High Court of Gujarat. The Hon'ble High court of Gujarat vide civil notice has directed that the clearance of the goods in question are subject to final outcome of this petition and details of the goods cleared be maintained and all the exporter importer of the goods be informed that the litigation in the form of this petition is pending. 5. Hence, it is therefore requested to follow the directions of the Hon'ble High court of Gujarat and letter issued by Tariff Unit till the outcome of SCA No. 7760 of 2019. 6.
